Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, MRF 759-3.50 B, MRF-759-PL 01 B and SB-JS-685-TS A, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
The tree protection measures to accommodate the installation of the air source heat pump hereby approved shall be implemented in accordance with the approved plans MRF-759-3.50 B, MRF-759-PL 01 B and SB-JS-685-TS A and supporting information set out in Tree report Rev A, to ensure the satisfactory protection of protected trees that are located adjacent to the proposed heat pump.
Reason: To safeguard trees which are visually important in accordance with Policies CS1, CSEN3 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies C4, C9, CON5, CON7, D1, G2 and H13 of the South Oxfordshire Local Plan 2011.
The landscaping scheme as shown on the approved plan SB/JS/685/TS/Rev A shall be implemented prior to the first use of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority.
Reason: To help to assimilate the development into its surroundings in accordance with Policies CS1, CSEN3 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies C4, CON5, CON7, D1, G2 and H13 of the South Oxfordshire Local Plan 2011.
The existing hedge along the whole of the Southern boundary of the land shall be retained and properly maintained at a height of not less than 1.5 metres and any plant which may die or be seriously damaged or destroyed within 5 years of the completion of the development shall be replaced and the replacement shall be properly maintained.
Reason: To help to assimilate the development into its surroundings in accordance with Policies CS1, CSEN3 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies C4, CON5, CON7, D1, G2 and H13 of the South Oxfordshire Local Plan 2011.
All plant (air source heat pump) to be used by reason of the granting of this permission shall be so installed, maintained and operated in accordance with the details specified on the plans and supporting documents hereby approved or in details which shall previously have been approved in writing by the Local Planning Authority. In the event of unacceptable noise or vibration being caused by the installed plant, machinery and equipment, the applicant or persons responsible shall investigate and undertake appropriate attenuation works to resolve the problem to the satisfaction of the local planning authority.
Reason: To protect the occupants of nearby residential properties from loss of amenity due to noise disturbance and in accordance with Policies EP1 and EP2 of the South Oxfordshire Local Plan 2011.
