Conditions / Refusal Reasons
The development, by reason of the introducing significant built-form on this site with the associated hardstanding and the gates and adjacent piers, results in an overt intrusion into the existing rural character, appearance and setting of the site. Furthermore, this has resulted in the loss of the verdant character and appearance of the site which has eroded the rural character and setting of nearby listed buildings. As such the development is contrary to Policies DES1 DES2, ENV1, ENV7 of the adopted South Oxfordshire Local Plan 2035 and Policies BER1 and BER2 of the adopted Berrick Salome Neighbourhood Plan 2034.
The site lies within Flood Zone 2 and 3, with part of the site in Flood Zone 3b. This application fails to demonstrate that the site and the highly vulnerable use would not lie within Flood Zone 3. The development fails to determine the development's potential impacts on floodwater storage and flows and also fails to adequately demonstrate that the development will be suitably resistant to flooding. Furthermore, the submitted Flood Risk Assessment fails to comply with the requirements for site-specific flood risk assessments. As such the development fails to adhere to the National Planning Policy Framework (NPPF), Policy EP4 of the adopted South Oxfordshire Local Plan 2035 and Policy BER10 of the Berrick Salome Neighbourhood Plan 2034.
The application has not been supported by an appropriate contamination assessment and it has not been possible to demonstrate whether the development would not, or has not, been affected by any known land contamination. As such the development fails to adhere to Policies ENV11 and ENV12 of the adopted South Oxfordshire Local Plan and the National Planning Policy Framework (NPPF).
