Conditions / Refusal Reasons
That having regard to the removal of the site from the wider curtilage of Red Cow House and the loss of the ancillary relationship with Red Cow House, the proposed development would diminish the contribution that the site currently makes to the significance of the listed building and would result in less than substantial harm which is not outweighed by the benefits of the development. As such, the proposed development fails to adhere to the National Planning Policy Framework, Policies CSR1 and CSEN3 of the South Oxfordshire Core Strategy, and saved Policy CON5 of the South Oxfordshire Local Plan 2011.
The proposed development, by reason of its independent residential use, scale and size would appear as both cramped and would adversely impact upon the existing green rural character and appearance of the site which contributes positively towards the character of both the Chilterns Area of Outstanding Natural Beauty and the Stoke Row Conservation Area. As such, the proposed development fails to adhere to the National Planning Policy Framework, Policies CS1, CSR1, CSQ3, CSEN1 and CSEN3 of the South Oxfordshire Core Strategy, saved Policies, D1, G2, H4 and CON7 of the South Oxfordshire Local Plan 2011.
This application does not adequately confirm that the proposed development would not be adversely harmed by any known sources of existing or previous forms of land contamination. As such, the proposed development fails to adhere to the National Planning Policy Framework and saved Policy EP8 of the South Oxfordshire Local Plan 2011.
