The available information, on the balance of probability, does not support the applicant's claim that the objet d'art, which is the subject of the application, constitutes a 'building operation' subject to a 4 year enforcement immunity period under Section 171B(1) of the Town and Country Planning Act ('the Act'). Rather it constitutes part of a material change of use of the wider planning unit from agriculture to a mixed use, namely, 1) agriculture and 2) the display of artwork. This material change of use occurred less than 10 years prior to the date of the application and does not benefit from planning permission. It therefore remains vulnerable to enforcement action under Section 171B(3) of the Act and cannot be regarded as lawful within the meaning of Section 191 of the Act.
