The available evidence, on the balance of probability, supports the owner's claim that the yard has been used for a mixed use comprising 1) agriculture; and 2) non-agricultural storage for a continuous and uninterrupted period of at least 10 years prior to the date of the application. The above mixed use is therefore immune from enforcement action under Section 171B of the Town and Country Planning Act ('the Act') and must therefore be regarded as lawful within the meaning of Section 191 of the Act.
