Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, R856.11A, R856.02 and R856.01, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

The development hereby permitted shall not be occupied at any time other than for purposes ancillary to the residential use of the dwelling known as Midsummer Cottage. Reason: As the separate occupation of the accommodation would represent an undesirable sub-division of the property and result in inadequate standards of amenity and privacy and would adversely affect the character of the conservation area in accordance with Policy CSEN3 of the South Oxfordshire Core Strategy and policies H4 and CON 7 of the South Oxfordshire Local Plan 2011.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order) the provision within the curtilage of the dwelling of any building, enclosure or swimming pool as described in Schedule 2, Part 1, Class E of the Order shall not be undertaken without obtaining planning permission for the Local Planning Authority. Reason: To ensure the Local Planning Authority retains control over any future development as specified in the condition in the interests of amenity in accordance with Policies CSEN3 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies CON5 and CON7 of the South Oxfordshire Local Plan 2011.

That prior to the first use of the building hereby approved, the 1.8m fence shall be erected along the southern boundary of the application site extending as far as the end of the proposed patio as shown on plan ref R856.11A. Reason: To protect the amenity of the neighbour in accordance with policy H13 of the South Oxfordshire Local Plan
