Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004. Related application(s): P19/S2906/DIS, P19/S4627/DIS

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 18118.02, 2977-1, 18118.04 Rev A, 18118.01, 18118.03, 2977-1 Rev A, 18118.06 Rev A, 18118.05 Rev B, HTS-LND-01D and HTS-TPP-01D, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

That all existing buildings on the site shall be demolished before the new development hereby permitted commences, and any demolished material which is not to be utilised in the new development shall be removed from the land, unless an alternative scheme for the phased demolition of the building and removal of materials is first submitted to and approved in writing by the Local Planning Authority. Reason: To ensure satisfactory comprehensive development in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, D1 and H4 of the South Oxfordshire Local Plan 2011.

Except in the case of any building work hereby permitted, no change in the levels of the land shall take place unless in accordance with a detailed scheme which shall have been submitted to and approved in writing by the Local Planning Authority before any development commences on site. The scheme shall include details of existing and proposed ground levels in relation to an off-site fixed datum point. Reason: To ensure a satisfactory form of development in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, D1 and H4 of the South Oxfordshire Local Plan 2011.

Prior to any construction of the development hereby approved above foundation level, a schedule of all materials to be used in the external construction and finishes of the development hereby permitted shall be submitted to and approved in writing by the Local Planning Authority. Reason: In the interests of the visual appearance of the development in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, D1 and H4 of the South Oxfordshire Local Plan 2011.

The first floor en-suite and bedroom windows in the north-east facing elevation of the dwelling hereby permitted shall be glazed in obscure glass with a minimum of level 3 obscurity, and shall be fixed shut with the exception of a top hung openable fanlight, prior to the first occupation of the accommodation and it shall be retained as such thereafter. Reason: To ensure that the development is not unneighbourly in accordance with Policies G2, D4 and H4 of the South Oxfordshire Local Plan 2011.

Notwithstanding the provisions of the Town and Country (General Permitted Development Order) 2015 (or any Order revoking or re-enacting that Order), no development as specified in Schedule 2, Part 1, Class A - Extensions; Class B - Roof Extensions; Class E - Outbuildings; Class F - Hardstandings shall be undertaken without obtaining planning permission for the Local Planning Authority. Reason: The specific circumstances of this site warrant the Local Planning Authority having control over any further development as specified in the condition in the interests of amenity and in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, D1 and H4 of the South Oxfordshire Local Plan 2011.

Prior to the first occupation of the development hereby approved, the parking and turning areas shall be provided in accordance with the approved plan 18118.03 and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times. Reason: In the interests of highway safety and in accordance with Policies G2, D2, H4, T1 and T2 of the South Oxfordshire Local Plan 2011.

The garage accommodation hereby approved shall be retained as such and shall not be adapted for living purposes without planning permission from the Local Planning Authority. Reason: In the interests of highway safety and to ensure the provision of adequate off-street car parking in accordance with Policies G2, D2, H4, T1 and T2 of the South Oxfordshire Local Plan 2011.

The landscaping scheme as shown on the approved plan landscaping plan (HTS-LND-01D) and set out at Appendix F of the submitted Arboricultural Method Statement (Date July 2019) shall be implemented prior to the first occupation or use of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the retained existing or proposed trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority. Reason: To help to assimilate the development into its surroundings in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9, D1 and H4 of the South Oxfordshire Local Plan 2011.

The tree protection details as shown on the approved Arboricultural Method Statement (Date July 2019) and shown on the Tree Protection Plan (HTS-TPP-01D) shall be put in place prior to any on site works including demolition and thereafter retained in situ for the duration of development. Reason: To safeguard trees which are visually important in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9, D1 and H4 of the South Oxfordshire Local Plan 2011

Prior to the commencement of the development hereby approved, including any site clearance, stripping or demolition, evidence of the successful receipt of a European protected species licence, or evidence of the successful registration of the site under the bat mitigation class licence, specific to this development, from Natural England, shall be submitted to and approved in writing by the local planning authority. Reason: To protect the important species on site, in accordance with Policy CSB1 of the South Oxfordshire Core Strategy, Policies C6 and C8 of the South Oxfordshire Local Plan 2011 and Paragraph 170 of the NPPF.

The development hereby approved shall be implemented strictly in accordance with the all measures stated in section 6 of the supporting Bat Survey Report (Green Link Ecology Ltd, 20/05/2019, Reference: 19_1467_Report_MF_HDF). This condition will be discharged through the receipt of a letter from the project ecologist providing evidence that the approved details have been implemented in accordance with this condition. Reason: To minimise the impact of development on biodiversity, in accordance with Policy CSB1 of the South Oxfordshire Core Strategy, Policies C6 and C8 of the South Oxfordshire Local Plan 2011 and Paragraph 170 of the NPPF.
