Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than 20 February 2021. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, D02D, LP, S02C, PDR BGG 101 RO, D03 E, SY01A, PDR BGG 100 RO, 02C, D01J, S03H, 01D and 04, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

The exterior of the development hereby permitted shall only be constructed in the materials specified on the plans hereby approved or in the letter from Kavan Davies Architecture Limited dated 15 May 2019 or in materials which shall previously have been approved in writing by the Local Planning Authority. Reason: In the interests of the visual appearance of the development in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2 and D1 of the South Oxfordshire Local Plan 2011.

The rooflights hereby approved shall be set flush with the plane of the roof in which they are to be inserted. Reason: In the interests of protecting the special historical character of the Waterstock Conservation Area in accordance with Policy CSEN3 of the South Oxfordshire Core Strategy 2027 and Policy CON7 of the South Oxfordshire Local Plan 2011.

External lighting will only be permitted in accordance with a lighting scheme to be approved in writing by the local planning authority. Any such lighting shall be directed downwards to protect the unlit and rural characteristics of the area from light spillage. Reason: To protect the appearance of the area and in the interests of protecting the unlit character of the Waterstock Conservation Area, in accordance with with Policy CSEN3 of the South Oxfordshire Core Strategy 2027, and Policies EP3 and CON7 of the South Oxfordshire Local Plan 2011.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order), the enlargement, improvement or other alteration of any dwellinghouse as described in Schedule 2, Part 1, Class A of the Order shall not be undertaken without obtaining planning permission for the Local Planning Authority. Reason: To ensure the Local Planning Authority retains control over any future development as specified in the condition in the interests of protecting the landscape and securing the openness of the Green Belt, and in accordance with Policies CSQ3, CSEN1 and CSEN2 of the South Oxfordshire Core Strategy 2027 and Policies C4, GB4, G2 and D1 of the South Oxfordshire Local Plan 2011.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order) the provision within the curtilage of the dwelling of any building, enclosure or swimming pool as described in Schedule 2, Part 1, Class E of the Order shall not be undertaken without obtaining planning permission for the Local Planning Authority. Reason: To ensure the Local Planning Authority retains control over any future development as specified in the condition in the interests of protecting the landscape and securing the openness of the Green Belt, and in accordance with Policies CSQ3, CSEN1 and CSEN2 of the South Oxfordshire Core Strategy 2027 and Policies C4, GB4, G2 and D1 of the South Oxfordshire Local Plan 2011.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development Order) 2015 (or any Order revoking or re-enacting that Order) the erection or construction of gates, fences, walls or other means of enclosure as described in Schedule 2, Part 2, Class A of the Order shall not be undertaken without obtaining planning permission for the Local Planning Authority. Reason: To ensure the Local Planning Authority retains control over any future development as specified in the condition in the interests of protecting the landscape and securing the openness of the Green Belt, and in accordance with Policies CSQ3, CSEN1 and CSEN2 of the South Oxfordshire Core Strategy 2027 and Policies C4, GB4, G2 and D1 of the South Oxfordshire Local Plan 2011.

That the development hereby approved shall be implemented in accordance with the recommendations made in section 5 of the supporting Bat Survey Report (01/10/2016, Ref: 012_batrep_finalv2), with at least two replacement roosting opportunities, as described in appendix 6 of the supporting Bat Survey Report, being erected. Any variation from the approved details shall be agreed in writing with the Local Planning Authority before any such change is implemented. Reason: To protect the important species on site, in accordance with Policies C6 and C8 of the South Oxfordshire Local Plan 2011, and Policy CSB1 of the South Oxfordshire Core Strategy.

Prior to the first occupation of the development, the existing means of access onto the Unanamed Road leading out of Waterstock shall be improved and laid out and constructed strictly in accordance with the local highway authority's specifications and all ancillary works specified shall be undertaken. Reason: In the interest of highway safety in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.

Prior to the implementation of the development vision splays measuring 2.4 metres by 43 metres shall be provided to each side of the access and the vision splays shall not be obstructed by any object, structure, planting or other material with a height exceeding or growing above 0.9 metres as measured from carriageway level. Reason: In the interest of highway safety in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.

Prior to the first occupation of the development hereby approved, the parking and turning areas shall be provided in accordance with the approved plans 937.02c and 937.04 and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times. Reason: In the interests of highway safety and in accordance with Policies T1 and T2 of the South Oxfordshire Local Plan 2011.
