The erection of a detached two storey 4-bedroom dwelling, detached garage and retrospective close boarded timber fence, entrance gates and brick piers (as amplified by contaminated land information received on 8th May 2019 and Ecological Appraisal received on 17th May 2019)
Conditions / Refusal Reasons
The construction of a detached dwelling at this site, by reasons of the scale and location, would result in a form of development in direct conflict with the spatial development strategy of the development plan by extending the built-up limits of the 'other village' into the open countryside contrary to policies CSS1 and CSR1 of the South Oxfordshire Core Strategy 2026 and saved policies H4, G2 and G4 of the South Oxfordshire Local Plan 2011.
The construction of a detached dwelling with associated detached garage and domestic landscaping, by reasons of the scale, location and design, would create an overly suburban visual intrusion into the open countryside with a high risk of Damage occurring to existing mature trees in and adjacent to the site, resulting in unacceptable harm to the character and appearance of the local street scene and the landscape setting of the rural village contrary to policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2026 and policies C4, C9, D1, G2, G4 and H4 of the South Oxfordshire Local Plan 2011.
The existing front boundary fence and associated conifer planting, by reasons of the scale, location and design, have introduced a prominent and overly suburban addition to the street scene causing unacceptable harm to the distinctive rural village character and appearance of the area and landscape setting of the village contrary to policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2026 and policies C4, C9, D1, G2, G4 and H4 of the South Oxfordshire Local Plan 2011.
The proposed development would result in the creation of a 'more vulnerable' type of development within Flood Zone 3b. The applicant has failed to demonstrate that the development would be outside of a high-risk area, would provide wider sustainability benefits to the community that outweigh the flood risk and that the development will be safe for its lifetime, without increasing flood risk elsewhere. The development is therefore in conflict with Section 14 of the National Planning Policy Framework and the advice within National Planning Practice Guidance (Flood risk and coastal change).
