Amendment to planning application P15/S3387/FUL to amend the fenestration of residential plots 17, 18, 20, 21, 23, 87, 25, 52, 57, 53, 54, 70, 71, 83, 84 and 85. (As amended by plans received 2019-06-06 to clarify drawings and as further amended by plans 2019-07-12 to introduce false windows and brick courses to certain plots).
Conditions / Refusal Reasons
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, CABI-PL 17-18-20 Rev.C, CABI-PL 25 Rev B, CABI-PL 21 Rev B, CABI-PL 23-87 Rev.C, CABI-PL 52-57 Rev.B, CABI-PL 53 Rev A, CABI-PL 54 Rev A, CABI-PL 70 Rev A, CABI-PL 71 Rev B, CABI-PL 83 Rev A, CABI-PL 84 Rev A, CABI-PL 85 Rev A, MDL 1296 W100 and BA00121 PL1, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
The exterior of the development hereby permitted shall only be constructed in the materials as approved by application reference P18/S2367/DIS.
Reason: In the interests of the visual appearance of the development in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2 and D1 of the South Oxfordshire Local Plan 2011.
No dwelling shall be occupied until the internal road system linking that dwelling to Nosworthy Way has been constructed to binder or surface course level in accordance with approved Drawing Reference No:2808.P.04_H of planning permission granted in respect of application reference P15/S3387/FUL.
Reason: In the interests of highway safety and to ensure a satisfactory standard of construction and layout for the development, in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.
The Construction Traffic Management Plan (CTMP) as approved by application reference P18/S2184/DIS shall be implemented and shall be maintained throughout the course of the development.
Reason: In the interests of highway safety and to mitigate the impact of construction vehicles on the surrounding highway network, road infrastructure and local residents, particularly at morning and afternoon peak traffic times and in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.
No dwelling shall be occupied until a Travel Plan relating to the residential development has been submitted to and approved in writing by the local planning authority. The Travel Plan shall include the arrangements for its review and a timetable for implementation. The development shall be carried out in accordance with the approved details in the Travel Plan.
Reason: To promote the use of non car modes of transport in accordance with Policy CSM2 of the South Oxfordshire Core Strategy 2027.
The residential development shall be implemented in accordance with foul drainage details as approved by application reference P18/S2565/DIS.
Reason: To prevent pollution in accordance with Policy EP1 of the South Oxfordshire Local Plan 2011.
The development hereby permitted shall be implemented in accordance with the surface water details as approved by application reference P18/S2565/DIS.
Reason: To prevent pollution and flooding in accordance with Policies EP1, EP4 and EP6 of the South Oxfordshire Local Plan 2011.
The development must be implemented in accordance with the approved archaeological written scheme of investigation and the staged programme of archaeological evaluation and mitigation as approved by application references P18/S1272/DIS and P19/S0390/DIS.
Reason: To enable an appropriate level of archaeological investigation of the area including excavation and recording, post excavation analysis and the publication of results in accordance with Policy CSEN3 of the South Oxfordshire Core Strategy 2027 and Policies CON11, CON13 and CON14 of the South Oxfordshire Local Plan 2011.
The development shall be implemented in accordance with details submitted and approved by application reference P18/S2780/DIS. The fire hydrants shall be connected to the mains water supply and development shall be carried out in accordance with the approved details and timetable.
Reason: In the interests of fire safety in accordance with Policy CSI1 of the South Oxfordshire Core Strategy 2027.
External lighting will be implemented in accordance with details submitted and approved by application reference P18/S2561/DIS.
Reason: To protect the appearance of the area, the environment and wildlife, and local residents from light pollution in accordance with Policy EP3 of the South Oxfordshire Local Plan 2011.
The development shall be carried out in accordance with the recommendations and enhancements contained in chapter 6 (excluding 6.11 relating to offsite enhancement measures) of the Ecological Appraisal by Aspect Ecology (October 2015).
Reason: To protect the important species on the site, in accordance with provisions of the NPPF and policies CSB1 of the South Oxfordshire Core Strategy 2027 and C8 of the South Oxfordshire Local Plan 2011.
The development shall be implemented in accordance with the Landscaping details submitted and approved by application reference P18/S2758/DIS. Development shall be carried out in accordance with the approved scheme. Any trees or plants which within a period of 5 years from the completion of the residential development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species.
Reason: To help to assimilate the development into its surroundings in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9 and D1 of the South Oxfordshire Local Plan 2011.
The development shall by implemented in accordance with the approved details relating to the layout of the proposed play area, a timetable for provision and the provisions for its future maintenance as approved by application reference P18/S2758/DIS. Development shall be carried out in accordance with the approved details and timetable.
Reason: To meet the need for children's play space in accordance with Policy CSI1 of the South Oxfordshire Core Strategy 2027.
The development shall be implemented in accordance with the Arboricultural Method Statement as submitted and approved by application reference P18/S2184/DIS. Thereafter these details shall be retained in situ for the duration of development.
Reason: To safeguard trees which are visually important in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9 and D1 of the South Oxfordshire Local Plan 2011
The development shall be implemented in accordance with the approved remediation strategy for contamination, as approved by application reference P18/S4317/DIS.
Reason: To ensure that any ground, water and associated gas contamination is identified and adequately addressed to ensure the safety of the development, the environment and to ensure the site is suitable for the proposed use in accordance with Policy EP8 of the South Oxfordshire Local Plan 2011.
No dwelling shall be occupied until a verification report demonstrating completion of works set out in the approved remediation strategy and its effectiveness has be submitted to and approved in writing by the local planning authority. The report shall include results of sampling and monitoring carried out to demonstrate that the site remediation criteria have been met. It shall also include a plan for longer-term monitoring of pollutant linkages, maintenance and arrangements for contingency action, as identified in the verification report. This plan shall be implemented as approved.
Reason: To ensure that any ground, water and associated gas contamination is identified and adequately addressed to ensure the safety of the development, the environment and to ensure the site is suitable for the proposed use in accordance with Policy EP8 of the South Oxfordshire Local Plan 2011.
If, during the course of the residential development, contamination not previously identified is found to be present at the site then no further development shall be carried out until a remediation strategy has been submitted to and approved in writing by the local planning authority detailing how this unsuspected contamination shall be dealt with. The approved remediation strategy shall be implemented as approved.
Reason: To ensure that any ground, water and associated gas contamination is identified and adequately addressed to ensure the safety of the development, the environment and to ensure the site is suitable for the proposed use in accordance with Policy EP8 of the South Oxfordshire Local Plan 2011.
