Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, PL 01, PL 02, PL 03 and PL 04, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
Conversion of the building hereby approved shall not commence until full details of the external materials to be used in the construction of the development have first been submitted to and approved in writing by the Local Planning Authority. The written details shall include (but not be strictly limited to) a photographic example of each material, the material name and manufacturer/supplier name.
Reason: To ensure the development is compatible with its surroundings, to protect the settings of the nearby grade II listed buildings and rural character and appearance of the area in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies E8, G2 and D1 of the South Oxfordshire Local Plan 2011.
The dwelling hereby approved shall not be occupied or brought into use until a scheme for the planting of trees and shrubs within the site has been carried out in full in accordance with written details that shall first be submitted to and approved in writing by the Local Planning Authority. The written details shall include:
- Details of the species, locations and numbers of all trees, shrubs and hedges to be planted (to include a tree(s) in the south-western area of the site to provide some privacy screening between the permitted dwelling and neighbouring property at Blenheim Farmhouse);
- written planting and maintenance specifications;
- Plan showing all trees/hedges to be retained;
- Plan showing all trees/hedges to be removed.
In the event of any of the trees, shrubs or hedges planted as part of the approved scheme dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree, shrub or hedge of equivalent number and species, or of a species and number as first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority.
Reason: To help to assimilate the development into its surroundings in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies E8, G2, C9 and D1 of the South Oxfordshire Local Plan 2011.
The development hereby approved shall be completed strictly in accordance with the recommendations of the Initial Ecology Appraisal (James Johnson Ecology - 28th January 2019), including any pre-commencement checks or surveys required to be undertaken.
Reason: To ensure no harm is caused to protected species during the development in accordance with the aims of policy CSB1 of the South Oxfordshire Core Strategy 2027 and Policies E8, C6 and C8 of the South Oxfordshire Local Plan 2011.
Should any evidence of protected species using the building be found as a result of the requirements of condition 5 of this planning permission, the development shall not continue until the applicant (or their successor in title) has provided confirmation of the successful receipt of a European Protected Species (EPS) Licence (or evidence of the successful registration of the site under the bat low impact mitigation class licence, specific to this development, from Natural England) and received written approval from the Local Planning Authority.
Thereafter the development shall proceed strictly in accordance with the requirements of the EPS licence.
Reason: To ensure no harm is caused to protected species during the development in accordance with the aims of policy CSB1 of the South Oxfordshire Core Strategy 2027 and Policies E8, C6 and C8 of the South Oxfordshire Local Plan 2011.
Prior to the first occupation of the dwelling hereby approved, the existing means of access onto the Unnamed Road (Icknield Way), shall be improved and laid out and constructed strictly in accordance with the local highway authority's specifications and all ancillary works specified shall be completed in full. The access and associated visibility splays shall be maintained in accordance with the approved specifications thereafter.
Reason: In the interest of highway safety in accordance with policy T1 of the South Oxfordshire Local Plan 2011.
Prior to the first occupation of the development hereby approved, the parking and turning areas shall be provided in accordance with the approved plan PL01 (Location and Site Plan) and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles. Thereafter the parking and turning areas shall be retained unobstructed except for the parking of vehicles associated with the development at all times.
Reason: In the interests of highway safety and in accordance with Policies T1 and T2 of the South Oxfordshire Local Plan 2011.
The site access shall be used solely for domestic purposes associated with the dwelling hereby approved and at no time following occupation of the dwelling shall the access be used for any vehicles associated with the commercial use of the wider site (the land and buildings directly to the north and east).
Reason: In the interest of highway safety in accordance with policy T1 of the South Oxfordshire Local Plan 2011.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 (or any Order revoking or re-enacting that Order with or without modification) no development covered by Schedule 2, Part 1, Classes A, B, C, D, E and F shall be carried out without planning permission first being sought and granted by the District Planning Authority.
Reason: to protect the landscape character of the AONB and to prevent harm being caused to the amenity of the area in accordance with policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies E8, G2, D1 and D3 of the South Oxfordshire Local Plan 2011.
