The information submitted on behalf of the owners is not sufficiently precise and unambiguous to warrant the grant of a certificate of lawfulness. The owners' account of events is also contradicted by evidence from other sources that renders the owners' account less than probable. On balance of probability the application building and its identified garden area had not been used as a separate self-contained dwelling for a period of at least 4 years prior to the application date. The existing use was therefore vulnerable to enforcement action under S.171B(2) of the Town and Country Planning Act (the Act) and was not lawful within the meaning of S.191 of the Act on the date of the application.
