Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 07-043-F-820, 0745 1.1, 07-043-F-821, 07-043-F-802, 07-043-F-801, 07-043-F-871, 07-043-F-870, 07-043-F-831, 07-043-M-400, 1 of 2 Rev P01 and 2 of 2 Rev P01, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

The exterior of the development hereby permitted shall only be constructed in the materials specified within section 7 of the application forms hereby approved or in materials which shall previously have been approved in writing by the Local Planning Authority. Reason: In the interests of the visual appearance of the development in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies D1, G2 and H12 of the South Oxfordshire Local Plan 2011.

The landscaping scheme as shown on the approved plan 0745 1.1 shall be implemented prior to the first occupation or use of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority. Reason: To help to assimilate the development into its surroundings in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies C9, D1, and G2 of the South Oxfordshire Local Plan 2011.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order), the enlargement of any dwellinghouse as described in Schedule 2, Part 1, Class A of the Order shall not be undertaken without obtaining planning permission for the Local Planning Authority. Reason: To ensure the Local Planning Authority retains control over any future development as specified in the condition in the interests of the protection of the openness of the Oxford Green Belt and in accordance with Policies CSEN2 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policy GB4 of the South Oxfordshire Local Plan 2011.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order), the enlargement of the roof of any dwellinghouse as described in Schedule 2, Part 1, Class B of the Order shall not be undertaken without obtaining planning permission for the Local Planning Authority. Reason: To ensure the Local Planning Authority retains control over any future development as specified in the condition in the interests the protection of the openness of the Oxford Green Belt and in accordance with Policies CSEN2 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policy GB4 of the South Oxfordshire Local Plan 2011.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order) the provision within the curtilage of the dwelling of any building, enclosure or swimming pool as described in Schedule 2, Part 1, Class E of the Order shall not be undertaken without obtaining planning permission for the Local Planning Authority. Reason: To ensure the Local Planning Authority retains control over any future development as specified in the condition in the interests of the protection of the openness of the Oxford Green Belt and in accordance with Policies CSEN2 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policy GB4 of the South Oxfordshire Local Plan 2011

That prior to the first occupation of the dwelling hereby approved, all outbuildings and other structures not shown to be retained on approved site plan drawing 07-043-F-821 shall be demolished and the materials used in their construction, including foundation materials, removed from the land' Reason: To ensure that additional new build development that would be harmful to the openness of the Green Belt is not undertaken between the date that planning permission is granted and the date that the approved scheme is implemented in accordance with Policy CSEN2 of the South Oxfordshire Core Strategy 2027 and Policy GB4 of the South Oxfordshire Local Plan 2011.

Prior to occupation of the dwelling hereby approved the proposed means of access onto Cuddesdon Road is to be formed and laid out and constructed strictly in accordance with the local highway authority's specifications and all ancillary works specified shall be undertaken. Reason: In the interest of highway safety in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.

Prior to the first occupation of the dwelling hereby approved vision splays measuring 2.4 metres by 43 metres shall be provided to each side of the access and the vision splays shall not be obstructed by any object, structure, planting or other material with a height exceeding or growing above 0.9 metres as measured from carriageway level. Reason: In the interest of highway safety in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.

Prior to the first occupation of the dwelling hereby approved, the parking and turning areas shall be provided in accordance with the approved plan drwgno 07-043/F/801 and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times. Reason: In the interests of highway safety and in accordance with Policies T1 and T2 of the South Oxfordshire Local Plan 2011.

Prior to the commencement of the dwelling hereby approved, including any site clearance or demolition, a report containing the findings of the bat activity survey(s) recommended in section 7.1 and 7.2 of the supporting Extended Phase 1 Habitat Survey and Preliminary Bat Survey Report (4 Acre Ecology Ltd, 01/11/2018) shall be submitted to and approved in writing by the local planning authority. This report shall explore any protected species licencing requirements for the development and propose a proportionate scheme of mitigation and enhancement for the site. Thereafter, the development shall be implemented in accordance with the approved details. Reason: To minimise the impact of development on biodiversity and protect the important species on site, in accordance with Policy CSB1 of the South Oxfordshire Cores Strategy 2027, Policies C6 and C8 of the South Oxfordshire Local Plan 2011 and paragraph 170 of the NPPF.

The development shall be implemented in accordance with the measures stated in sections 7.4-7.17 of the supporting Extended Phase 1 Habitat Survey and Preliminary Bat Survey Report (4 Acre Ecology Ltd, 01/11/2018). Any variation from the approved details shall first be approved in writing by the local planning authority prior to any such change being implemented. Reason: To minimise the impact of development on biodiversity in accordance with Policy CSB1 of the South Oxfordshire Core Strategy 2027, Policy C6 of the South Oxfordshire Local Plan 2011 and paragraph 170 of the NPPF.

Prior to the commencement of development hereby approved, a full surface water drainage scheme, including details of the size, position and construction of drainage works, shall be submitted to, and approved in writing by, the Local Planning Authority. The drainage scheme shall be designed to accommodate a 1 in 100 year storm + 40% CC and will be implemented in accordance with the approved details prior to the works commencing on construction of the dwelling hereby approved. Reason: To prevent pollution and flooding in accordance with Policies EP1, EP4 and EP6 of the South Oxfordshire Local Plan 2011.

Prior to the commencement of development hereby approved, a full foul water drainage scheme shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall include details of the size, position and construction of the drainage scheme, all coupled with calculations to evidence this. Reason: To prevent pollution in accordance with Policy EP1 of the South Oxfordshire Local Plan 2011.

All excavated materials from the development hereby approved shall be removed from site prior to the first occupation of the development. Reason: To help to assimilate the development into its surroundings and protect the openness and visual amenity of the Oxford Green Belt in accordance with Policies CSEN2 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies D1, G2, H12 and GB4 of the South Oxfordshire Local Plan 2011.
