Description
A reserved matters application for the erection of 241 dwellings (including 40% affordable) with associated internal access, public open space, landscaping, sports provision, nature park and woodland, provision of community facilities including relocated school playing fields, youth hut, skate park and play space in association with outline application P16/S1139/O. Amendments. 1. As amended by revised drawings listed on drawing issue sheet 17212 dated 12 October 2018 and transport note, 2. As clarified by landscape drawings on ACD Environmental drawing issue sheet dated 17 October 2018 3. As amended by drawings accompanying Agent's email dated 7 November 2018 with amended Design and Access Statement to remove reference to the MUGA. The B&W layout and coloured layout now removes the MUGA and includes a note in the key of the former referring to the skate park as discussed. Other plans are included only because there was reference to the MUGA carried over from the previous layout plan. 4. Conditions / Refusal Reasons
That the development hereby approved shall be carried out in accordance with the details shown on the approved plans as set out on the drawing issue sheet dated 14 November 2018, landscaping plans CALA21943-11 sheets 1 - 12 and landscaping masterplan CALA 21943 1D or as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies. Related application(s): P19/S0139/DIS, P19/S1933/RM

The exterior of the development hereby permitted shall only be constructed in the materials specified on set out on drawings 17212 - P104-1C and 2C or in materials which shall previously have been approved in writing by the Local Planning Authority. Reason: In the interests of the visual appearance of the development in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2 and D1 of the South Oxfordshire Local Plan 2011. Related application(s): P19/S0139/DIS

Prior to the first occupation of the any dwelling/flat hereby approved, the parking and turning areas for that dwelling/flat shall be provided in accordance with the approved plans 17212 - P107 - 1C and 2C and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times. Reason: In the interests of highway safety and in accordance with Policies T1 and T2 of the South Oxfordshire Local Plan 2011.

The affordable housing scheme shall be provided in accordance with the clustering shown on drawing 17212 - P101E, unless otherwise approved In writing by the LPA. Reason: To appropriately further disperse affordable units on the site in accordance with the requirements of the S106 agreement and Policy CSH4 of the South Oxfordshire Core Strategy.

With the exception of the exclusions specified in the NB below, the approved landscaping scheme detailed on drawings CALA21943-11 sheets 1 - 12 shall be implemented in accordance with landscape phasing details which have submitted and approved by the Local Planning Authority prior to any development above DPC. The approved details thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority. Reason: To help to assimilate the development into its surroundings in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9 and D1 of the South Oxfordshire Local Plan 2011. NB: For the avoidance of doubt the approved landscaping scheme for this reserved matters permission specifically excludes consent for any detailed landscaping scheme for the Nature Park and the Lady Brook Buffer. Landscaping for the Lady Brook Buffer and the Nature Park areas are covered under conditions 20 and 21 of the outline approval. You are advised to consult with the council's ecology officer regarding the design of the Nature Park and Buffer area in association with the design shown in principle on landscape masterplan drawing CALA 21943 1D.

Bicycle parking facilities shall be provided for each dwelling prior to the occupation of that dwelling, in accordance with details (including a timetable for delivery) to be submitted to and approved in writing by the Local Planning Authority, prior to the provision of the facilities. Reason: To encourage the use of cycles as a means of transport in accordance with Policy T2 of the South Oxfordshire Local Plan 2011.

The garages hereby approved shall be retained as such and shall not be adapted for living purposes without planning permission from the Local Planning Authority. Reason: In the interests of highway safety and to ensure the provision of adequate off-street car parking in accordance with Policies T1 and T2 of the South Oxfordshire Local Plan 2011.

No dwelling shall be occupied until the individual vehicular access and footpaths to serve that dwelling shown on the layout plan accompanying the application, (except for the final surfacing thereof) have been laid out, constructed, lit and drained. If required, temporary or permanent traffic calming shall be put in place in accordance with the previously approved details. Reason: In the interests of highway safety and to ensure a satisfactory standard of construction and layout for the development, in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.

Prior to the commencement of the development hereby approved, and notwithstanding the application details, full details of an 11.6m refuse vehicle turning within the site shall be submitted to and approved in writing by the Local Planning Authority. Thereafter, the development shall be carried out in accordance with the approved details unless otherwise approved in writing by the LPA . Reason: In the interests of highway safety and to ensure a satisfactory standard of construction and layout for the development, in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.
