Conditions / Refusal Reasons
The proposed development would result in a cramped form of development, by virtue of its use as a separate dwelling, at odds with the established character and appearance of the immediate surrounding area. As such the development conflicts with the provisions of the National Planning Policy Framework (NPPF, 2018); Policies CSR1 and CSQ3 of the South Oxfordshire Core Strategy and saved policies H4, D1, and G2 of the South Oxfordshire Local Plan 2011, and guidance contained within the South Oxfordshire Design Guide.
The proposed development would result in inadequate outdoor amenity space for the new dwelling and the existing dwelling due to the size of the garden areas and the presence of a protected Oak tree in the neighbouring garden on the south-west boundary of the site. As such the development conflicts with Policy D3 of the South Oxfordshire Local Plan 2011, and guidance contained within the South Oxfordshire Design Guide.
Due to its location and close proximity to the protected Oak tree on the south-western boundary, the proposed development would result in significant future pressure to prune or fell this protected tree and would therefore have a significant detrimental impact on the amenity value that the tree provides. As such, the development would be contrary to policies CSEN1 of the Core Strategy, and Policy C9 of the South Oxfordshire Local Plan 2011, and guidance contained within the South Oxfordshire Design Guide.
