Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, SMITH.0618.3/3, BL 001, SMITH.0618.4, SMITH.0618.5, SMITH.0618.3/2, SMITH.0218., SMITH.0218.1 and LOC 001, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

That the materials to be used for the external walls and roofs of the development hereby approved shall be of the same colour, type and texture as those used on the existing building(s). Reason: In the interests of the visual appearance of the development in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, H4 and D1 of the South Oxfordshire Local Plan 2011.

The development hereby permitted shall not be occupied at any time other than for purposes ancillary to the residential use of the dwelling known as Siplak House. Reason: As the separate occupation of the accommodation would represent an undesirable sub-division of the property and result in inadequate standards of amenity and privacy in accordance with Policy H13 and H4 of the South Oxfordshire Local Plan 2011.

The ground floor window in the rear elevation of the development hereby permitted shall be glazed in obscure glass with a minimum of level 3 obscurity, and shall be fixed shut with the exception of a top hung openable fanlight, prior to the first occupation of the accommodation and it shall be retained as such thereafter. Reason: To ensure that the development is not unneighbourly in accordance with Policy H4 of the South Oxfordshire Local Plan 2011.

The existing rear wall of the outbuilding shall be retained along the rear boundary following demolition of the building and it shall be retained at the height existing below the eaves and shall not be altered in any way unless otherwise agreed in writing by the Local Planning Authority. Reason: In the interests of retaining privacy to the neighbouring property and the visual appearance of the development in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2 and D1, H4 of the South Oxfordshire Local Plan 2011.

The development shall be implemented in accordance with the measures set out in the submitted Flood Risk Assessment (FRA). Reason: In order to mitigate flood risk, in accordance with advice within the National Planning Policy Framework and the Environment Agency's Flood Risk Standing Advice.
