Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004. Related application(s): P21/S2455/DIS

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, TPP001, 17.WTCS.PP01, 17.WTCS.PE01, 17 WTCS SLP01 rev A, MORE.1701, 17 WCTS S01 rev D and 17 WCTS SP01 rev L, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

Prior to the commencement of the development hereby approved a schedule of all materials to be used in the external construction and finishes of the development (including boundary treatments and hardsurfacing) hereby permitted shall be submitted to and approved in writing by the Local Planning Authority. Reason: In the interests of the visual appearance of the development in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2 and D1 of the South Oxfordshire Local Plan 2011.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order), the enlargement, improvement or other alteration of any dwellinghouse as described in Schedule 2, Part 1, Classes A, B or C of the Order shall not be undertaken without obtaining planning permission for the Local Planning Authority. Reason: To ensure the Local Planning Authority retains control over any future development as specified in the condition in the interests of neighbour amenity and in accordance with Policy H13 of the South Oxfordshire Local Plan 2011.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order) the provision within the curtilage of the dwelling of any building, enclosure or swimming pool as described in Schedule 2, Part 1, Class E of the Order shall not be undertaken without obtaining planning permission for the Local Planning Authority. Reason: To ensure the Local Planning Authority retains control over any future development as specified in the condition in the interests of neighbour amenity in accordance with Policy H13 of the South Oxfordshire Local Plan 2011.

The bedroom window in the north elevation of the dwelling hereby permitted shall be glazed in obscure glass with a minimum of level 3 obscurity, and shall be fixed shut with the exception of a top hung openable fanlight, prior to the first occupation of the accommodation and it shall be retained as such thereafter. Reason: To ensure that the development is not unneighbourly in accordance with Policies D4 and H4 or H13 of the South Oxfordshire Local Plan 2011.

The cill level of the roof lights in the east elevation shall be at least 1.7 metres above the floor level of the associated rooms and shall be retained as such. Reason: To ensure that the development is not unneighbourly in accordance with Policies H4 and D4 of the South Oxfordshire Local Plan 2011.

Prior to the first occupation of the development hereby approved, the parking and turning areas shall be provided in accordance with the approved plan 17 WTCS SP01 rev L and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times. Reason: In the interests of highway safety and in accordance with Policies T1 and T2 of the South Oxfordshire Local Plan 2011.

No surface water from the development shall be discharged onto the adjoining highway. Reason: In the interests of highway safety in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.

The rating noise levels arising from the air source heat pump shall not exceed 5 dBA below the background noise level at the facade of adjoining residential accommodation. Reason: To ensure that no undue nuisance is caused to the occupiers of neighbouring properties and the area generally in accordance with Policy EP1 of the South Oxfordshire Local Plan 2011.
