Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 7547.1 REV 1, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

Notwithstanding the provisions of the schedule to the Town and Country Planning (Use Classes) Order 1987, the use of the building hereby permitted shall be solely for the storage of materials and equipment ancillary to the adjacent Anaerobic Digestion Plant site and at no time shall the building be used for any other form of independent commercial or business use. Reason: To prevent the establishment of an independent commercial or business use in an unsustainable rural location and to ensure the existing renewable energy site is supported in accordance with the aims of policies CSQ1 and CSEN1 of the South Oxfordshire Core Strategy 2027 and policies EP5, G2, G4 and D1 of the South Oxfordshire Local Plan 2011.

The development hereby permitted shall utilise the adjacent Anaerobic Digestion Plant site access onto the public highway at Icknield Road and at no time shall any other access point be used for vehicle trips associated with the development (including construction traffic). Reason: To ensure the development benefits from a safe access to the public highway, to protect the amenities of adjacent site occupiers and in the general interests of highway safety in the vicinity of the site in accordance with policy CSM1 of the South Oxfordshire Core Strategy 2027 and policies T1 and T2 of the South Oxfordshire Local Plan 2011.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended) no external lighting shall be installed at the site unless planning permission has first been sought and granted by the Local Planning Authority. Reason: To prevent lighting from becoming a source of nuisance to nearby properties and uses and to ensure the protected characteristics of the Area of Outstanding Natural Beauty are conserved in accordance with the aims of policy CSEN1 of the South Oxfordshire Core Strategy 2027 and policies EP3, G2, C9 and D1 of the South Oxfordshire Local Plan 2011.

In the event the Anaerobic Digestion Plant (to which the development hereby permitted would serve in an ancillary function) becomes permanently disused or disused for a period exceeding one year, all equipment relating to this development, including any associated hard-surfaced areas or site roads, shall be removed and the site restored in accordance with the recommendations of the site restoration scheme that was previously submitted to and approved in writing by the Local Planning Authority (in relation to condition 14 of planning permission P13/S34121/FUL) under discharge of condition application reference P14/S1462/DIS approved on 3rd August 2015. Reason: To ensure that the site is restored in an orderly manner to a condition capable of beneficial after use and in the interests of the amenities of local residents in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9 and D1 of the South Oxfordshire Local Plan 2011.

The developer shall confirm in writing to the Local Planning Authority the presence of any unsuspected contamination encountered during the development. In the event of any contamination to the land and/or water being encountered, no development shall continue until a programme of investigation and/or remedial works to include methods of monitoring and certification of such works undertaken has been submitted to and approved in writing by the local planning authority. Reason: To ensure that any ground, water and associated gas contamination is identified and adequately addressed to ensure the safety of the development, the environment and to ensure the site is suitable for the proposed use in accordance with Policy EP8 of the South Oxfordshire Local Plan 2011.

No surface water from the development shall be discharged onto the adjoining highway. Reason: In the interests of highway safety in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.
