Reserved Matters application for approval of the appearance, landscaping, layout and scale of one detached two storey dwelling. following outline planning permission P16/S0699/O for the erection of a detached dwelling with garaging and associated amenity space and separate garage and pedestrian access for No.1 Lower Icknield Way with all matters reserved except for access (dwelling changed from four to three bedrooms and depth of rear projection reduced, parking spaces serving new dwelling reduced from three to two and garage to No.1 amended to allow access through as shown on amended plans received 4th February 2019).
Conditions / Refusal Reasons
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, LOC001, 1609-SP1D and 1609-P1C, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
The development hereby permitted shall begin no later than two years from the date of approval of the last of the reserved matters to be approved.
Reason: By virtue of Section 91 to 95 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
The first floor bathroom windows in the north-east facing side elevation and south-east facing rear elevation of the dwelling hereby permitted shall be glazed in obscure glass with a minimum of level 3 obscurity, and shall be fixed shut with the exception of a top hung openable fanlight, prior to the first occupation of the development and shall be retained as such thereafter.
Reason: To ensure that the development is not unneighbourly in accordance with Policies G2, D4 and H4 of the South Oxfordshire Local Plan 2011.
Notwithstanding the provisions of the Town and Country (General Permitted Development Order) 2015 (or any Order revoking or re-enacting that Order), no development as specified in Schedule 2, Part 1, Class A - Extensions; Class B - Roof Extensions; Class E - Outbuildings shall be undertaken without obtaining planning permission from the Local Planning Authority.
Reason: The specific circumstances of this site warrant the Local Planning Authority having control over any further development as specified in the condition in the interests of amenity and in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, D1 and H4 of the South Oxfordshire Local Plan 2011.
Notwithstanding the requirements of Condition 5 of outline planning permission P16/S0699/O, prior to the first occupation of the development hereby approved, the parking and turning areas shall be provided in accordance with the approved plan 1609/SP1D and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times.
Reason: In the interests of highway safety and in accordance with Policies G2, D2, H4, T1 and T2 of the South Oxfordshire Local Plan 2011.
No development shall take place above foundation level until a comprehensive scheme for the landscaping of the site, including the planting of live trees and shrubs, the treatment of the driveway and hardstandings and the provision of boundary treatment has been submitted to and approved in writing by the Local Planning Authority. The scheme shall be implemented prior to the first occupation of development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority.
Reason: To help to assimilate the development into its surroundings in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9, D1 and H4 of the South Oxfordshire Local Plan 2011.
