Variation of condition 2 (approved plans) for planning permission P16/S3989/FUL in order to substitute elevations, plans, and the site plan (as amended by revised plan and landscape plan received 12th December 2018)
Proposed family dwelling and garage on vacant land. Application represents an amendment to approved application reference; (APP/Q3115/W/16/3148649). (As amended and supported by revised plans and arboricultural report received on 13 March 2017, Site Plan Landscaping Plan Addendum to Arboriculture Impact Assessment and Landscaping Plan March 2017 accompanying e-mail from agent received 3 April 2017 and amended Site Plan received 05 April 2017)
Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than 21 June 2020 (the date of the original permission).
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, Location Plan 15007-L01, Block Plan 15007-P201f, drwgno 15007-P203a, drwgno 15007-P202a, drwgno 15007-P206a, drwgno 15007-P205a, drwgno 15007-P204c and drwgno 15007-P207 except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
The tree protection details, as set out in the submitted Arboricultural Method Statement (Date: 26/06/18 (revised 05/12/18) and Tree Protection Plan (Rev A, Dec 2018) submitted with
Application P18/S3539/DIS, shall be put in place prior to any on site works including demolition and thereafter retained in situ for the duration of development.
Reason: To safeguard trees which are visually important in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9 and D1 of the South Oxfordshire Local Plan 2011
THIS CONDITION FROM THE ORIGINAL PLANNING PERMISSION HAS BEEN DISCHARGED BY THE SUBMISSION OF THE ARCHAEOLOGICAL WRITTEN SCHEME OF INVESTIGATION SUBMITTED UNDER P18/S3539/DIS.
The appointed archaeologist must be present on site for the commencement of development to carry our the watching brief in accordance with the details approved under application P18/S3539/DIS Once the watching brief has been completed its findings shall be reported to the Local Planning Authority, as agreed in the Written Scheme of Investigation, including all processing, research and analysis necessary to produce an accessible and useable archive and a full report for publication.
Reason: To enable an appropriate level of archaeological investigation of the area including excavation and recording, post excavation analysis and the publication of results in accordance with Policy CSEN3 of the South Oxfordshire Core Strategy 2027 and Policies CON11, CON13 and CON14 of the South Oxfordshire Local Plan 2011.
The materials approved under application P18/S3539/DIS shall be used in the external construction and finishes of the development hereby permitted unless otherwise agreed in writing by the Local Planning Authority.
Reason: In the interests of the visual appearance of the development in accordance with Policy CSQ3, CSEN3 of the South Oxfordshire Core Strategy 2027 and Policies G2 and D1 of the South Oxfordshire Local Plan 2011.
Prior to occupation of the development hereby permitted the proposed means of access onto The Green is to be formed and laid out and constructed strictly in accordance with the local highway authority's specifications and all ancillary works specified shall be undertaken
Reason: In the interest of highway safety in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.
Before the proposed access is first used, the existing access onto The Green shall be permanently stopped up by the means of reinstatement of the highway verge and proposed planting to the approval of the Local Planning Authority and in accordance with the local highway authority's specifications. Thereafter the closed access shall not be used by any vehicular traffic whatsoever.
Reason: In the interest of highway safety in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.
The landscaping scheme as shown on the approved landscaping plan dated March 2017, the Tree protection plan Rev A Dec 2018 submitted with P18/S3539/DIS and Block Plan 17 - 1548 - 55C shall be implemented prior to the first occupation of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority.
Reason: To help to assimilate the development into its surroundings in accordance with Policies CSEN3 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9 and D1 of the South Oxfordshire Local Plan 2011.
Prior to the first occupation of the development hereby approved, the parking and turning areas shall be provided in accordance with drawing no. 17 - 1548 - 55C and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times.
Reason: In the interests of highway safety and in accordance with Policies T1 and T2 of the South Oxfordshire Local Plan 2011.
The garage accommodation hereby approved shall be retained as such and shall not be adapted for living purposes without the prior written permission of the Local Planning Authority.
Reason: In the interests of highway safety and to ensure the provision of adequate off-street car parking in accordance with Policies T1 and T2 of the South Oxfordshire Local Plan 2011.
Notwithstanding the provisions of The Town and Country Planning (General Permitted Development) Order 2015 (or any order revoking and re-enacting that Order with or without modification), no development within Classes A, B, C and E of Part 1 to Schedule 2 of the Order shall take place.
Reason: To ensure the Local Planning Authority retains control over any future development as specified in the condition in the interests of amenity and in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2 and D1 of the South Oxfordshire Local Plan 2011.
