Erection of one new dwelling, amenity space, parking and associated access. (As amended by revised drawings received 13th July proposing single storey dwelling with basement & amplified by plan ref 17-04-11 showing indicative curtilage of new dwelling and amended by plans 17-04-03B,04B,06C,07C,08C and 11A received on 27 September which increase the distance between the rear elevation of the proposed dwelling and boundary wall at the southern boundary of the site and widen the basement).
Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 17.04.03B, 17-04-11A, 17-04-06C, 17-04-07C, 17-04-08C, 17.04.04B, 17.04.05A, 18555.200.01A, 8171028.6101B, 17.04.10, 17.04.09, 17.04.01 and 17.04.02, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
Prior to first occupation of the dwelling hereby approved, the existing means of access onto Church Road shall be improved and laid out and constructed strictly in accordance with the local highway authority's specifications and all ancillary works specified shall be undertaken.
Reason: In the interest of highway safety in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.
The vision splays shown on the approved plan 8171028/6101 Rev B shall not be obstructed by any object, structure, planting or other material with a height exceeding or growing above 0.6 metres as measured from carriageway level.
Reason: In the interest of highway safety in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.
Prior to the first occupation of the development hereby approved, the parking and turning areas shall be provided in accordance with the approved plan 17-04-03 Rev B and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times.
Reason: In the interests of highway safety and in accordance with Policies T1 and T2 of the South Oxfordshire Local Plan 2011.
The garage/carport accommodation hereby approved shall be retained as such and shall not be adapted for living purposes without planning permission from the Local Planning Authority.
Reason: In the interests of highway safety and to ensure the provision of adequate off-street car parking in accordance with Policies T1 and T2 of the South Oxfordshire Local Plan 2011.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order), the enlargement, improvement or other alteration of any dwellinghouse as described in Schedule 2, Part 1, Class A of the Order shall not be undertaken without obtaining planning permission for the Local Planning Authority.
Reason: To ensure the Local Planning Authority retains control over any future development as specified in the condition in the interests of preserving the Wheatley conservation area and the setting of the listed building in accordance with Policy CSEN3 of the South Oxfordshire Core Strategy 2027 and Policies Con 5 ,Con 7 and C9 of the South Oxfordshire Local Plan 2011.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order) the provision within the curtilage of the dwelling of any building, enclosure or swimming pool as described in Schedule 2, Part 1, Class E of the Order shall not be undertaken without obtaining planning permission for the Local Planning Authority.
Reason: To ensure the Local Planning Authority retains control over any future development as specified in the condition in the interests of preserving the Wheatley conservation area and the setting of the listed building in accordance with Policy CSEN3 of the South Oxfordshire Core Strategy 2027 and Policies Con 5 ,Con 7 and C9 of the South Oxfordshire Local Plan 2011..
Prior to the commencement of any site works (including demolition or site clearance) a protected area shall be designated for all existing trees which are shown to be retained, and the trees shall be protected in accordance with a scheme which complies with the current edition of BS 5837: "Trees in relation to design, demolition and construction" that shall first have been submitted to, and approved in writing by, the Local Planning Authority. The agreed measures shall be kept in place during the entire course of development.
Reason: To safeguard trees which are visually important in accordance with Policies CSEN3 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies Con 7,G2, C9 and D1 of the South Oxfordshire Local Plan 2011.
Prior to the commencement of the development hereby approved samples of the materials to be used for the external walls including the boundary wall (stone) and roof(zinc) shall be submitted to and approved in writing by the Local Planning Authority.
Reason: In the interests of the visual appearance of the development in accordance with Policies CSEN3 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies Con 5, Con 7 and G2 of the South Oxfordshire Local Plan 2011.
That prior to the first occupation of the new dwelling hereby approved, details of the new entrance gates shall be submitted to and approved in writing by the Local Planning Authority.
Reason: To ensure that the details of the development are acceptable and preserve the character of the Wheately conservation area in accordance with policy CSEN 3 of the South Oxfordshire Core Strategy and policy CON 7 of the South Oxfordshire Local Plan.
The making good to the stone wall either side of the gates shall be carried out in stone and lime mortar to match the existing.
Reason: To ensure that the details of the development are acceptable and to preserve the character of the Wheatley conservation area in accordance with policy CSEN 3 of the South Oxfordshire Core Strategy and policy CON 7 of the South Oxfordshire Local Plan.
Prior to the commencement of development, sustainable drainage details should be submitted and approved in writing by the Local Planning Authority. These should include:
1. Full details of sustainable surface water drainage based on ground permeability tests to BRE 365 and groundwater monitoring;
2. Design calculations with appropriate climate change allowance and storage areas sizing;
3. Full Suds construction details and proposals based on the above;
4. Detailed proposed site and floor levels;
5. Foul water drainage proposals
Reason: To prevent pollution and flooding in accordance with Policies EP1, EP4 and EP6 of the South Oxfordshire Local Plan 2011.
