For alterations and additions to existing private residential dwellinghouse and Change Of Use from private residential to Class D1 educational child's school nursery at Hillview, Horton Road, Stanton St. John, OX33 1AG. (as supported by additional land contamination information, submitted 25 April 2018).
Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, A5, A0 A, A6 A, A1, A4, A3, A7, A9, A8, A2 A, LOC 001 and LOC 002, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
The exterior of the development hereby permitted shall only be constructed in the materials specified on the plans and application form hereby approved or in materials which shall previously have been approved in writing by the Local Planning Authority.
Reason: In the interests of the visual appearance of the development in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2 and D1 of the South Oxfordshire Local Plan 2011.
Prior to the construction of the new wall on the front boundary, details of the wall, gates and soft landscaping to the front boundary shall be submitted to and approved in writing by the Local Planning Authority. The approved wall, gates and landscaping shall be implemented prior to the first use of the nursery.
Reason: To help to assimilate the development into its surroundings in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9 and D1 of the South Oxfordshire Local Plan 2011.
That the buildings specified in the application to be demolished shall be demolished prior to the first use of the nursery.
Reason: To protect the openness of the Green Belt in accordance with Policy CSEN2 of the South Oxfordshire Core Strategy 2027 and Policy GB4 of the South Oxfordshire Local Plan 2011.
That the development hereby approved shall be implemented in accordance with the recommendations made in section 6 of the supporting Bat Survey Report (Windrush Ecology, November 2017, Ref: W2652_rep_Outbuilding at Hillview_08-11-17). Any variation from the approved details shall be agreed in writing by the local planning authority prior to any such changes being implemented.
Reason: To protect any important species on site, in accordance with Policies C6 and C8 of the SOLP, Policy CSB1 of the SOCS and paragraph 109 of the NPPF.
Prior to the first use of the nursery hereby permitted the proposed means of access onto Horton Road is to be formed and laid out and constructed strictly in accordance with the local highway authority's specifications and all ancillary works specified shall be undertaken
Reason: In the interest of highway safety in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.
Before the proposed access to the new parking area is first used, the existing access from the proposed parking area onto Horton Road shall be permanently stopped up by the means of reinstatement of the highway verge and proposed planting to the approval of the Local Planning Authority and in accordance with the local highway authority's specifications. Thereafter the closed access shall not be used by any vehicular traffic whatsoever.
Reason: In the interest of highway safety in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.
The proposed vision splay shall be formed, laid out and constructed in accordance with detailed plans which shall be submitted to and approved in writing by the Local Planning Authority prior to the first use of the nursery and the vision splays shall not be obstructed by any object, structure, planting or other material with a height exceeding or growing above 0.6 metres as measured from carriageway level.
Reason: In the interest of highway safety in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.
Prior to the first use of the nursery hereby approved, the parking and turning areas shall be provided in accordance with drawing no. A2, Rev A, and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times.
Reason: In the interests of highway safety and in accordance with Policies T1 and T2 of the South Oxfordshire Local Plan 2011.
Cycle parking facilities shall be provided prior to the first use of the nursery hereby approved, in accordance with details to be submitted to and approved in writing by the Local Planning Authority, prior to the commencement of development.
Reason: To encourage the use of cycles as a means of transport in accordance with Policy T2 of the South Oxfordshire Local Plan 2011.
Prior to the first use of the nursery hereby permitted a Green Travel Plan shall be drawn up, and submitted to and approved in writing by the Local Planning Authority; such plans to include proposals for all travel by modes other than the private car for journeys to and from site.
Reason: To promote the use of non car modes of transport in accordance with Policy CSM2 of the South Oxfordshire Core Strategy 2027.
The hours of operation for construction and demolition works shall be restricted to 08:00-18:00 Monday to Friday and 08:00-13:00 on a Saturday. No work is permitted to take place on Sundays or Public Holidays without the prior written authority of the Local Planning Authority.
Reason: To protect the occupants of nearby residential properties from noise disturbance in accordance with Policy EP2 of the South Oxfordshire Local Plan 2011.
The developer shall ensure that the appropriate provision is made for the control of noise emanating from the site, so as not to cause undue disturbance to the occupants of nearby residential properties.
Reason: To protect the occupants of nearby residential properties from loss of amenity due to noise disturbance and in accordance with Policy EP2 of the South Oxfordshire Local Plan 2011.
No surface water from the development shall be discharged onto the adjoining highway
Reason: In the interests of highway safety in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.
