Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 08-001-S-001, 08-001-S-002, 08-001 F 504, 08-001-F-508, 08-001-F-506, 08-001-F-505 rev B, 08-001-F-507, 08-001-F-502 rev A and 08-001-F-501 rev B, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

Prior to the commencement of the development hereby approved, a report containing the findings of the bat activity surveys recommended in section 7.1 of the supporting Preliminary Bat Survey (4 Acre Ecology Ltd, 10/01/2019) shall be submitted to and approved in writing by the local planning authority. This report shall also contain a proportionate biodiversity mitigation and enhancement strategy for the site. Thereafter, the development shall be implemented in accordance with the approved details. Reason: To protect the important species on site and secure net gains for biodiversity, in accordance with Policy CSB1 of the SOCS, Policies C6 and C8 of the SOLP and paragraph 170 of the NPPF.

Prior to the commencement of the development hereby approved, evidence of the successful receipt of a European protected species licence, or evidence of the successful registration of the site under the bat low impact mitigation class licence, specific to this development, from Natural England, shall be submitted to an approved in writing by the local planning authority. Reason: To protect the important species on site, in accordance with Policy CSB1 of the SOCS, Policies C6 and C8 of the SOLP and paragraph 170 of the NPPF.

Prior to the commencement of any site works (including demolition or site clearance) a protected area shall be designated for all existing trees which are shown to be retained, and the trees shall be protected in accordance with a scheme which complies with the current edition of BS 5837: "Trees in relation to design, demolition and construction" that shall first have been submitted to, and approved in writing by, the Local Planning Authority. The agreed measures shall be kept in place during the entire course of development. Reason: To safeguard trees which are visually important in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9 and D1 of the South Oxfordshire Local Plan 2011.

Construction of the dwelling(s) hereby approved shall not continue above slab level until full details of the external materials to be used in the construction of the development have first been submitted to and approved in writing by the Local Planning Authority. The written details shall include (but not be strictly limited to) a photographic example of each material, the material name and manufacturer/supplier name. Reason: To ensure the development is compatible with its surroundings, to protect the settings of the nearby grade II listed buildings and rural character and appearance of the area in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies H12, G2 and D1 of the South Oxfordshire Local Plan 2011.

The dwellings hereby approved shall not be occupied or brought into use until a scheme for the planting of trees and shrubs within the site has been carried out in full in accordance with written details that shall first be submitted to and approved in writing by the Local Planning Authority. The written details shall include: - Details of the species, locations and numbers of all trees, shrubs and hedges to be planted; - written planting and maintenance specifications; - Plan showing all trees/hedges to be retained; - Plan showing all trees/hedges to be removed. In the event of any of the trees, shrubs or hedges planted as part of the approved scheme dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree, shrub or hedge of equivalent number and species, or of a species and number as first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority. Reason: To help to assimilate the development into its surroundings in accordance with Policies CSEN1, CSEN2 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9 and D1 of the South Oxfordshire Local Plan 2011.

Prior to the first occupation of the development hereby approved, the parking and turning areas shall be provided in accordance with drawing no. 08-001/F/505, Rev A, and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times. Reason: In the interests of highway safety in accordance with policies D2, T1 and T2 of the South Oxfordshire Local Plan 2011.

Prior to the first occupation of the development, the existing means of access onto Woodperry Hill shall be improved and laid out and constructed strictly in accordance with the local highway authority's specifications and all ancillary works specified shall be undertaken. Reason: In the interest of highway safety in accordance with policy T1 of the South Oxfordshire Local Plan 2011.

The proposed vision splay shall be formed, laid out and constructed in accordance with detailed plans which shall be submitted to and approved in writing by the Local Planning Authority prior to the first occupation of the development and the vision splays shall not be obstructed by any object, structure, planting or other material with a height exceeding or growing above 0.9 metres as measured from carriageway level. Reason: In the interest of highway safety in accordance with policy T1 of the South Oxfordshire Local Plan 2011.

The dwellings hereby approved shall not be occupied or brought into use until all pre-existing buildings (not part of the approved development) within the site have been demolished in their entirety and all resultant waste/debris removed from the site. Reason: To preserve the openness of the Green Belt and in the interests of the residential amenities of future occupiers of the site in accordance with policies CSEN2 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, D1 and D3 of the South Oxfordshire Local Plan 2011.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 (or any Order revoking or re-enacting that Order with or without modification) no development covered by Schedule 2, Part 1, Classes A, B, C, D, E and F shall be carried out without planning permission first being sought and granted by the District Planning Authority. Reason: to protect the openness of the Green Belt and to prevent harm being caused to the amenity of the area in accordance with policies CSEN2 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, D1 and D3 of the South Oxfordshire Local Plan 2011.
