Variation of condition 2 (approved plans) & condition 4 (tree protection plan) of Planning Permission P17/S3077/FUL.
Erection of a replacement dwelling and detached garage/car port following demolition of the existing house and garage/lean-to carport. As amended by drawing nos b100c, , b122a received on Friday 3 November 2017 and drawing no b120c, Arboricultural report V3 and Tree Protection plan 3 received on 6 November 2017
Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than 9 November 2020.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, B122B, B100D, B121, B120D and 1, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
That the approved dwelling and garage shall be constructed in the materails and finishes approved by letter dated 22 December 2017 under DIS application ref P17/S4085/DIS unless otherwise agreed in writing by the Local Planning Authority.
Reason: In the interests of the visual appearance of the development in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2 and D1 of the South Oxfordshire Local Plan 2011.
The tree protection details as shown on the approved Arboricultural Report 3 (Dated 6 November 2017) submitted with P17/S3077/FUL and Tree Protection Plan 1 (Dated 22 December 2017) submitted with this application, shall be put in place prior to any on site works including demolition and thereafter retained in situ for the duration of development.
Reason: To safeguard trees which are visually important in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9 and D1 of the South Oxfordshire Local Plan 2011
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order), the enlargement, improvement or other alteration of any dwellinghouse as described in Schedule 2, Part 1, Class A of the Order shall not be undertaken without obtaining planning permission for the Local Planning Authority.
Reason: To protect the openness of the Green Belt in accordance with Policy CSEN3 of the South Oxfordshire Core Strategy 2027 and Policy GB4 of the South Oxfordshire Local Plan 2011.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order) the provision within the curtilage of the dwelling of any building, enclosure or swimming pool as described in Schedule 2, Part 1, Class E of the Order shall not be undertaken without obtaining planning permission for the Local Planning Authority.
Reason: To protect the openness of the Green Belt in accordance with Policy CSEN3 of the South Oxfordshire Core Strategy 2027 and Policy GB4 of the South Oxfordshire Local Plan 2011.
