The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004. Related application(s): P19/S0949/DIS

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, P2 B, P7 C, P6 D, P5 D, P1 A, P12 A, S1 A, P3 C, P4 B, MWA.TCP.001 and MWA.TPP.001, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies. Related application(s): P19/S0949/DIS

That the buildings specified in the application to be demolished shall be demolished within three months of the first occupation of the buildings hereby permitted. Reason: To ensure satisfactory comprehensive development in accordance with Policies CS1, CSEN1, CSEN3 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies C3, C4, CON5, D1, G2, G4 and R8 of the South Oxfordshire Local Plan 2011. Prior to the commencement of the development hereby approved samples of the materials to be used for the external walls and roofs shall be submitted to and approved in writing by the Local Planning Authority. Reason: In the interests of the visual appearance of the development in accordance with Policies CS1, CSEN1, CSEN3 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies C3, C4, C9, CON5, D1, G2, G4 and R8 of the South Oxfordshire Local Plan 2011.

The tree protection details, as shown in the submitted Arboricultural Survey and Report (DEV160728-146 dated 31 August 2016 prepared by MWA Arboriculture Ltd) and the accompanying tree protection plan MWA-TPP-001 , shall be put in place prior to any on site works including demolition and thereafter retained in situ for the duration of development. Reason: To safeguard trees which are visually important in accordance with Policies CS1, CSEN1, CSEN3 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies C3, C4, C9, CON5, D1, G2, G4, R8 of the South Oxfordshire Local Plan 2011.

The developer shall confirm in writing to the Local Planning Authority the presence of any unsuspected contamination encountered during the development. In the event of any contamination to the land and/or water being encountered, no development shall continue until a programme of investigation and/or remedial works to include methods of monitoring and certification of such works undertaken has been submitted to and approved in writing by the local planning authority. Reason: To ensure that any ground, water and associated gas contamination is identified and adequately addressed to ensure the safety of the development, the environment and to ensure the site is suitable for the proposed use in accordance with Policy EP8 of the South Oxfordshire Local Plan 2011.

Prior to the commencement of the development hereby permitted the foul drainage works must be designed so as to not malfunction or cause pollution at times of flood and in accordance with details that have been first submitted to and approved in writing by the Local Planning Authority, and shall be implemented in accordance with the approved details prior to the occupation of the development and thereafter retained unless otherwise agreed in writing by the Local Planning Authority. Reason: To prevent pollution in accordance with Policies EP1, EP4 and EP7 of the South Oxfordshire Local Plan 2011.

The development hereby permitted shall only be carried out in accordance with the submitted Flood Risk Assessment (FRA) 160301 v.04 dated 16 August 2016 prepared by GWP Consultants LLP and the following mitigation measures detailed within the FRA: 1. Provision of compensatory flood storage by way of ground removal as detailed in drawings No. SHIPFRA1603-07A and SHIPFRA1603-08A in the FRA. 2. Finished floor levels are set no lower than 35.475 metres above Ordnance Datum (mAOD). The mitigation measures shall be fully implemented prior to occupation and subsequently in accordance with the timing / phasing arrangements embodied within the scheme, or within any other period as may subsequently be agreed, in writing, by the Local Planning Authority. Reason: To prevent flooding elsewhere by ensuring that compensatory storage of flood water is provided and to reduce the risk of flooding to the proposed development and future occupants in accordance with the National Planning Policy Framework and Policies EP1, EP4 and EP7 of the South Oxfordshire Local Plan 2011.
