Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 1627.003, LOC001, 1627.006, 2827.1, 2827.6, BLO001, 1627.001 G, 1627.002 G, 1627.004, 1627.005 G, 1627.002, 1627.003 G, 1627.004 G, 1627.005, 1627.001, FDA.0524 B and 00266 F, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

The exterior of the development hereby permitted shall only be constructed in the materials specified on the plans and materials data sheet hereby approved or in materials which shall previously have been approved in writing by the Local Planning Authority. Reason: In the interests of the visual appearance of the development in accordance with Policies CS1, CSEN1, CSQ2 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies C4, D1, G4 and H4 of the South Oxfordshire Local Plan 2011.

Notwithstanding any details shown on the approved drawings, the new first-floor window(s) on the north east elevation shall be glazed with obscured glass and shall be fixed shut with the exception of a top hung fanlight and thereafter retained as such. Thereafter, the window(s) shall remain obscure glazed and fixed shut. Notwithstanding the provisions of Class A of Part 1 Schedule 2 of the Town and Country Planning (General Permitted Development) Order 1995 (or the equivalent provisions of any order revoking and re-enacting that Order), no additional first-floor openings shall be inserted in the north east elevation of the dwelling without the prior grant of planning permission. Reason: To protect the privacy of adjacent dwellings in accordance with Policies CS1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies D1, D4, G2 and H4 of the South Oxfordshire Local Plan 2011.

Two bat boxes shall be installed on site, either integrated into the new dwelling or erected on mature trees. The specific installation, location and specification of the two bat boxes shall be informed by a suitably qualified ecologist. Reason: To enhance the site for biodiversity, in accordance with Policy CSB1 of the SOCS and Paragraph 109 of the NPPF.

The landscaping scheme as shown on the approved plan 00266 F shall be implemented prior to the first occupation or use of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority. Reason: To help to assimilate the development into its surroundings in accordance with Policies CS1, CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies C4, C6, C8, C9, D1, G2, G4 and H4 of the South Oxfordshire Local Plan 2011.

The tree protection details as shown on the approved FDA.0524 B shall be put in place prior to any on site works including demolition and thereafter retained in situ for the duration of development. Reason: To safeguard trees which are visually important in accordance with Policies CS1, CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies C4, C6, C8, C9, D1, G2, G4 and H4 of the South Oxfordshire Local Plan 2011.

Prior to the first occupation of the development, the existing means of access onto the highway shall be improved and laid out and constructed strictly in accordance with the local highway authority's specifications and all ancillary works specified shall be undertaken. Reason: In the interest of highway safety in accordance with Policies T1 and T2 of the South Oxfordshire Local Plan 2011.

The vision splays shown on drawing no.00266/REV E, shall not be obstructed by any object, structure, planting or other material with a height exceeding or growing above 0.9 metres as measured from carriageway level. Reason: In the interest of highway safety in accordance with Policies T1 and T2 of the South Oxfordshire Local Plan 2011.

Prior to the first occupation of the development hereby approved, the parking and turning areas shall be provided in accordance with drawing no.00266/REV E, and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times. Reason: In the interests of highway safety and in accordance with Policies D2, T1 and T2 of the South Oxfordshire Local Plan 2011.

All plant, machinery and equipment to be installed as part of the open air swimming pool hereby approved shall be installed bellow ground, maintained and operated so as to prevent the transmission of noise and vibration into any premises either attached to, or in the vicinity of the premises to which the application refers. Reason: To protect the occupants of nearby residential properties from loss of amenity due to noise disturbance and in accordance with Policy EP2 of the South Oxfordshire Local Plan 2011.

The development hereby approved shall be laid out in accordance with the details shown on the approved plan 2827_6 showing the existing and proposed ground levels of the site together with the slab and ridge levels of the proposed development, relative to a fixed datum point on adjoining land outside of the application site. The development shall be carried out in accordance with the approved levels. Reason: To protect the amenity of adjacent dwellings in accordance with Policies CS1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies D1, D4, G2 and H4 of the South Oxfordshire Local Plan 2011.
