Description
Replacement dwelling (as amplified by the contaminated land survey submitted by the agent on 21 July, 2018). As amplified by plan ref 17 ADT P22 which shows the outline of the proposed dwelling in relation to the existing dwelling. As amplified by bat report received 10 October 2017.
Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 17 ADT SL01, 17 ADT SP21 B, 17 ADT SP20 B, 17 ADT P20 B and 17 ADT P22, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
Prior to the first occupation of the development hereby approved, the parking and turning areas shall be provided in accordance with the approved plan 17 ADT SP20 Rev B and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times.
Reason: In the interests of highway safety and in accordance with Policies T1 and T2 of the South Oxfordshire Local Plan 2011.
The developer shall confirm in writing to the Local Planning Authority the presence of any
unsuspected contamination encountered during the development. In the event of any
contamination to the land and/or water being encountered, no development shall continue until a
programme of investigation and/or remedial works to include methods of monitoring and
certification of such works undertaken has been submitted to and approved in writing by the local
planning authority.
Reason- To ensure that any ground, water and associated gas contamination is identified and
adequately addressed to ensure the safety of the development, the environment and to ensure the
site is suitable for the proposed development in accordance with policy EP8 of the South Oxfordshire Local Plan.
Prior to the commencement of the development hereby approved, including any site clearance or demolition, evidence of the successful receipt of a European protected species licence, or evidence of the successful registration of the site under the low impact bat class licence, shall be submitted to and approved in writing by the Local Planning Authority. Thereafter, the development shall be implemented in accordance with the details used to secure that licence.
Reason: To ensure the protection of the important species on site, in accordance with Policies C6 and C8 of the SOLP, Policy CSB1 of the SOCS and Paragraph 109 of the NPPF
Two Schwegler 2F bat boxes shall be erected on site and retained there in perpetuity. The specific location of the bat boxes shall be informed by a suitably qualified ecologist.
Reason: To ensure a net gain for biodiversity on site, in accordance with Policies C6 of the SOLP, Policy CSB1 of the SOCS and Paragraph 109 of the NPPF."
The tree protection details as shown in the arboricultural report submitted with the application shall be put in place prior to any on site works including demolition and thereafter retained in situ for the duration of development.
Reason: To safeguard trees which are visually important in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9 and D1 of the South Oxfordshire Local Plan 2011
