The available evidence supports the applicants' claim that since purchasing the dwelling and adjoining commercial premises in 1998 the applicants have lived in the dwelling as their primary residence but have not at any time been employed by any of the users of the adjoining commercial premises. Their occupation of the dwelling in breach of condition 3 of planning permission P85/N0708 has therefore been ongoing for more than 10 years. The council has no evidence of its own or from any other sources to contradict or otherwise render the applicants' account less than probable. The existing residential occupation of the dwelling contrary to condition 3 of planning permission P85/N0708 must therefore be regarded as immune from enforcement action under Section 171B of the Town and Country Planning Act ('the Act') and lawful within the meaning of section 191 of the Act
