Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, E01, P01, E12 B, P12 E, E10 C, E11 C, P10 F, P11 D and P13 C, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

Prior to the commencement of the development hereby approved samples of all materials to be used in the external construction and finishes of the development hereby permitted shall be submitted to and approved in writing by the Local Planning Authority. The details shall include the brick and bond in which they are to be laid, the cheeks, face and roof of the dormer windows, roof tiles, windows and doors Reason: In the interests of the visual appearance of the development in accordance with Policies CS1, CSHEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies CON7, D1, G2 and H4 of the South Oxfordshire Local Plan 2011.

The rooflights hereby approved shall be set flush with the plane of the roof in which they are to be inserted. Reason: In the interests of the visual appearance of the development in accordance with Policies CS1, CSHEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies CON7, D1, G2 and H4 of the South Oxfordshire Local Plan 2011.

A detailed specification of all external ducts, flue pipes or means of external venting shall be submitted to and approved in writing by the Local Planning Authority before development commences. Thereafter the development shall be constructed in accordance with the approved details. Reason: In the interests of the visual appearance of the development in accordance with Policies CS1, CSHEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies CON7, D1, G2 and H4 of the South Oxfordshire Local Plan 2011.

Habitable rooms fronting on to Duke Street at first and second floor level shall be provided with mechanical ventilation, unless it can be demonstrated by means of an air quality assessment that the concentration of nitrogen dioxide at the windows to these rooms does not exceed the Air Quality Objective of 40ug.m3 measured as an annual mean. The mechanical ventilation shall be provided in accordance with a scheme which shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development. Thereafter prior to the first occupation of the relevant flats the mechanical ventilation shall be provided and retained as approved. Reason: To ensure satisfactory standards of air quality for the residents of the flats in accordance with Policies CS1, CSHEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, EP1 and H4 of the South Oxfordshire Local Plan 2011.

Cycle parking facilities shall be provided prior to the occupation of the development hereby approved in accordance with the details shown on drawing P10 RevB. Reason: To encourage the use of cycles as a means of transport in accordance with Policies CS1, CSHEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies D2, G2, H4, T1 and T2 of the South Oxfordshire Local Plan 2011.

Other than cycles parked in the Sheffield bike stands provided the rear entrance lobby shall be kept free of obstructions at all times and used only for the specified purpose. Reason: In the interests of safety.

A Construction Traffic Management Plan (CTMP) shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of development. The approved CTMP shall be implemented prior to any works being carried out on site, and shall be maintained throughout the course of the development. Reason: In the interests of highway safety and to mitigate the impact of construction vehicles on the surrounding highway network, road infrastructure and local residents, particularly at morning and afternoon peak traffic times in accordance with Policies T1 and T2 of the South Oxfordshire Local Plan 2011.
