Outline Planning Application with all matters reserved (apart from access) for the erection of up to 51 dwellings & associated infrastructure and works.
(As clarified by additional information on ecology received 4 August 2017 and 15 September 2017, plus amended Transport Assessment and plans received 30 November 2017).
Conditions / Refusal Reasons
The application site is not allocated for housing development within the Chinnor Neighbourhood Plan, and the proposed development would not represent infill housing development within the existing built up form of the village. As a result the development would conflict with Chinnor Neighbourhood Plan policy CH H1.
The proposal would result in significant and demonstrable harm to the landscape and visual setting of the Chilterns Area of Outstanding Natural Beauty (AONB) and Chinnor Conservation Area. Furthermore, the development would detract from the public enjoyment of the site, adversely affecting the views to and from the AONB. As such, the development would be contrary to the National Planning Policy Framework, policies CSEN1, CSEN3 and CSQ3 of the South Oxfordshire Core Strategy, policies C4, G2, G4, D1 and CON7 of the South Oxfordshire Local Plan 2011, and policy CH C1 and CH C2 of the Chinnor Neighbourhood Plan.
In the absence of a completed Section 106 legal agreement, the proposal fails to secure affordable housing to meet the needs of the District. As such, the development would be contrary to the National Planning Policy Framework,
policy CSH3 of the South Oxfordshire Core Strategy and policies CH H2, CH H3 and CH H4 of the Chinnor Neighbourhood Plan.
In the absence of a completed Section 106 legal agreement, the proposal fails to secure infrastructure necessary to meet the needs of the development. As such, the development would be contrary to the National Planning Policy
Framework, policy CSI1 and CSM2 of the South Oxfordshire Core Strategy and policies T1, D10, D12, R2 and R6 of the South Oxfordshire Local Plan 2011.
In the absence of a completed Section 106 legal agreement, the proposal fails to provide compensation for the value of biodiversity lost on the application site. As such, the development would be contrary to the National Planning Policy Framework and policy CSB1 of the South Oxfordshire Core Strategy.
