The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004. Related application(s): P18/S3065/DIS, P20/S0902/DIS

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 16/011/001, 002, 001, TH/A2/1267/TPP, 16/011/001B, 002A, 001A and TH_A2_1267_TPPA 30_05_17, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies. Related application(s): P20/S0902/DIS

Prior to the commencement of development detailed plans showing the existing and proposed ground levels of the site together with the slab and ridge levels of the proposed development, relative to a fixed datum point on adjoining land outside of the application site, shall be submitted to and approved in writing by the Local Planning Authority. Thereafter the development shall be carried out in accordance with the approved details. Reason: To ensure a satisfactory form of development in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C4, D1 and H12 of the South Oxfordshire Local Plan 2011. Prior to the commencement of the development hereby approved, a schedule of all materials to be used in the external construction and finishes of the development hereby permitted shall be submitted to and approved in writing by the Local Planning Authority. Reason: In the interests of the visual appearance of the development in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C4, D1 and H12 of the South Oxfordshire Local Plan 2011.

The first floor south-east facing dormer window of the replacement dwelling hereby approved shall be obscure glazed to at least level 3 obscurity and fixed shut with the exception of a top-hung fanlight at least 1.7 metres above the floor level of the bedroom it serves and thereafter shall be retained as such. Reason: To ensure that the development is not unneighbourly in accordance with Policies G2, D4 and H12 of the South Oxfordshire Local Plan 2011.

Notwithstanding the details shown on the approved plans, the rooflights on the south-east facing roofslope of the replacement dwelling hereby approved shall be positioned at least 1.7 metres above the floor level of the bedrooms they serve and thereafter shall be retained as such. Reason: To ensure that the development is not unneighbourly in accordance with Policies G2, D4 and H12 of the South Oxfordshire Local Plan 2011.

Prior to the commencement of development details of the specification of external glazing, glass coating and integral blinds for the replacement dwelling hereby permitted shall be submitted to and approved in writing by the Local Planning Authority and thereafter implemented and retained in accordance with the approved details. Reason: To ensure that reflection and light spillage is kept to a minimum to safeguard the landscape character of the area in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C4, D1, EP3 and H12 of the South Oxfordshire Local Plan 2011.

Notwithstanding the provisions of the Town and Country (General Permitted Development Order) 2015 (or any Order revoking or re-enacting that Order), no development as specified in Schedule 2, Part 1, Class A - Extensions and Class E - Outbuildings and Class F - Hardstandings shall be undertaken without obtaining planning permission for the Local Planning Authority. Reason: The specific circumstances of this site warrant the Local Planning Authority having control over any further development as specified in the condition in the interests of amenity and in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C4, D1 and H12 of the South Oxfordshire Local Plan 2011.

Prior to the first occupation of the development hereby approved, the parking and turning areas shall be provided in accordance with the approved plan 001A and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times. Reason: In the interests of highway safety and in accordance with Policies G2, D2, H12, T1 and T2 of the South Oxfordshire Local Plan 2011.

Prior to the commencement of the development hereby permitted a scheme for the landscaping of the site, including the planting of live trees and shrubs, the treatment of the access road and hard standings, and the provision of boundary treatment shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall be implemented prior to the first occupation or use of development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority. Reason: To help to assimilate the development into its surroundings in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C4, C9, D1 and H12 of the South Oxfordshire Local Plan 2011.

The tree protection details as shown on the approved plan TH/A2/1267/TPP received 31st May 2017 and the Arboricultural Impact Assessment & Method Statement TH 1267/C dated 19th December 2016 shall be put in place prior to any on site works including demolition and thereafter retained in situ for the duration of development. Reason: To safeguard trees which are visually important in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C4, C9, D1 and H12 of the South Oxfordshire Local Plan 2011

Prior to the commencement of the development hereby approved, including any demolition and any works of site clearance, a mitigation strategy for bats which follow the recommendations contained in chapter 4 of the Preliminary Bat Roost Appraisal by GS Ecology including the results of bat activity surveys, timing of works, and the location and design of any alternative roosts to be provided, shall be submitted to and approved in writing by the Local Planning Authority. Thereafter, the mitigation works shall be carried out in accordance with the approved details. Reason: To protect the important species on the site in accordance with provisions of the NPPF and Policy CSB1 of the South Oxfordshire Core Strategy 2027 and Policies G2, C8 and H12 of the South Oxfordshire Local Plan 2011.

No development including site clearance stripping or demolition shall commence until either: a) a bat licence issued by Natural England pursuant to the Regulation 53 of The Conservation of Habitats and Species Regulations 2010 authorising the specified activity to go ahead; or b) proof of registration of the site under a low impact class licence, has been submitted to and agreed in writing by the Local Planning Authority. Thereafter, the approved measures shall be carried out and retained in accordance with the approved details. Reason: To protect the important species on the site in accordance with provisions of the NPPF and Policy CSB1 of the South Oxfordshire Core Strategy 2027 and Policies G2, C8 and H12 of the South Oxfordshire Local Plan 2011.

The proposed garage hereby permitted shall not be occupied at any time other than for purposes ancillary to the residential use of the dwelling known as Marigay. Reason: As the separate occupation of the accommodation would represent an undesirable sub-division of the property and result in inadequate standards of amenity and privacy in accordance with Policies G2, D4 and H12 of the South Oxfordshire Local Plan 2011.

External lighting will only be permitted in accordance with a lighting scheme to be approved in writing by the local planning authority. Any such lighting shall be directed downwards to prevent nuisance to adjoining residential occupiers from light spillage and shall be turned on only during the conditioned hours of operation and remain off at all other times. Reason: To protect the appearance of the area, the environment and wildlife, and local residents from light pollution in accordance with Policies G2, C4, EP3 and H12 of the South Oxfordshire Local Plan 2011.
