Conditions / Refusal Reasons
The height and scale of the proposed variation to the approved plans would represent inappropriate development in the green belt which would adversely affect the openness and visual amenity of the green belt contrary to policy CSEN2 of the South Oxfordshire Core Strategy, saved policy GB4 of the adopted South Oxfordshire Local Pan and to advice within the National Planning Policy Framework.
Having regard to the siting close to the north west boundary of Jubilee Cottage and the south west boundary of Ashleigh House, the proposed variation to the approved plans would result in an overbearing and oppressive form of development which would adversely affect the amenity of neighbours contrary to saved policy H4 of he South Oxfordshire Local Plan and to advice set out in the South Oxfordshire Design Guide
There is a reasonable likelihood that great crested newts (Triturus cristatus) are present on the adjacent site at Ashleigh House, and therefore potentially impacted by the application proposal. The applicant has been advised that ecological information in the form of great crested newt surveys are required. These surveys are needed to establish the authoritative view on the presence/absence of the protected species on the application site and adjacent site, how large the population is, assess the likely impacts of the development and design a suitable mitigation strategy. No such survey has been carried out or report submitted to the Local Planning Authority. As such, insufficient information has been submitted to demonstrate that the proposed development would not have an adverse impact on a European protected species. The proposal is therefore contrary to Policies C6 and C8 of the saved policies to the South Oxfordshire Local Plan, Policy CSB1 of the South Oxfordshire Core Strategy 2027, guidance contained within BS 42020 and paragraph 109 of the NPPF.
