Conditions / Refusal Reasons
The open and undeveloped fields surrounding the settlement form an integral part of the special character of the Brightwell cum Sotwell Conservation Area (as identified within the Brightwell-cum-Sotwell Conservation Area Appraisal, April 2006). The development would diminish the contribution of this site towards the character of the conservation area and accordingly harm its significance. This harm is less than substantial but is not in the view of the council outweighed by sufficient public benefits. The development fails to preserve and enhance the character and appearance of the conservation area contrary to Section 72(1) of the Planning (Listed Buildings and Conservation Areas) Act 1990, Paragraph 132 and 134 of the National Planning Policy Framework, Policy CSEN3 of the South Oxfordshire Core Strategy 2027 and Policy CON7 of the South Oxfordshire Local Plan 2011.

The emerging Brightwell cum Sotwell Neighbourhood Plan is afforded significant weight due to its stage of preparation. The council can demonstrate more than a 3 year supply of housing land. In line with the December 2016 ministerial statement the housing policies within neighbourhood plan would not be considered out of date. The presumption in favour of sustainable development set out in paragraph 14 of the National Planning Policy Framework is not therefore engaged. The neighbourhood plan provides for housing provision in line with the spatial strategy for the district and does not include the application site. The development would extend the built form of the village in to an open and undeveloped agricultural field which provides an attractive and important setting for the village thereby conflicting with the aims and objectives of the South Oxfordshire Core Strategy, Policy C4 of the South Oxfordshire Local Plan 2011 and Policy BCSI of the Brightwell cum Sotwell Neighbourhood Plan.

That, in the absence of a completed S106 agreement the proposal fails to i) secure affordable housing to meet the needs of the District and ii) secure other on and off site infrastructure necessary to support the development, and as such is contrary to policies CSH3 and CSI1 of the South Oxfordshire Core Strategy, saved Policy D10 of the South Oxfordshire Local Plan and the National Planning Policy Framework.
