Description
Application for three temporary refrigerated containers in the parking area of combined units 22-25 bakery. Units comprise of grey painted containers of 6m, 8.8m & 9.45m by 2.65m wide plus Danfoss Optyma LPHM136 low noise condensing units.The proposed position of the condensing units is at low level, sheltered by the insulated structures and would be 75m from the nearest residential dwelling (where the existing units are high and approx 45m away). The condensing units noise output is 70dB @ 1m and 48dB @ 10m. (as amended by drawings accompanying email from Agent dated 22 September 2016 and Noise Impact Assesment received 18 October 2016).

Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of 12 months beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, Location Plan 289-115, Site Block Plan 289-114 and Proposed Elevations Plan 289-110 rev B except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

All plant, machinery and equipment to be used by reason of the granting of this permission shall be installed, maintained and operated so as to ensure that the rating noise level from the equipment does not exceed the background noise level at the boundary of the premises. Measurement and rating of noise for the purposes of this condition shall be in accordance with BS4142 (2014) 'Method for rating industrial and commercial sound'. The measurement location shall be 1 metre from the facade of the nearest noise sensitive receptor. Reason: To protect the occupants of nearby residential properties from loss of amenity due to noise disturbance and in accordance with Policy EP2 of the South Oxfordshire Local Plan 2011.

No goods, materials, plant or machinery shall be stored, repaired, operated or displayed in the open without the prior permission of the Local Planning Authority. All storage shall be contained within the three (3) containers hereby permitted and/or the main building only. Reason: To safeguard the character of the area, the amenity of neighbouring residents and the openness of the countryside in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2 and D1 of the South Oxfordshire Local Plan 2011.

Within six (6) weeks of the commencement of development, all other structures and containers, including the two refrigerated lorries around the building currently stationed for storage purposes, shall be removed from the land. Reason: To safeguard the character of the area, the amenity of neighbouring residents and the openness of the countryside in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2 and D1 of the South Oxfordshire Local Plan 2011

Within one (1) month of "Brown Sugar Bakery" ceasing occupation of the land, the storage units hereby permitted shall be removed. Reason: In the interests of highway safety and in accordance with Policies T1 and T2 of the South Oxfordshire Local Plan 2011.
