Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 379 01, 2675, 16084 001 C and 16084 002C, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
Prior to the commencement of the development hereby approved samples of all materials to be used in the external construction and finishes of the development hereby permitted shall be submitted to and approved in writing by the Local Planning Authority.
Reason: In the interests of the visual appearance of the development in accordance with Policies CS1, CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies C4, D1, G2, G4 and H4 of the South Oxfordshire Local Plan 2011.
The cill level of the roof lights in the north east elevation shall be at least 1.7 metres above the floor level of the associated rooms and shall be retained as such. No additional rooflights shall be inserted into the north east elevation of the development hereby approved without the prior written permission of the Local Planning Authority.
Reason: To ensure that the development is not unneighbourly in accordance with Policies CS1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies H4 and D4 of the South Oxfordshire Local Plan 2011.
The landscaping scheme including the planting of live trees and shrubs and the provision of boundary treatment hereby permitted shall be implemented prior to the first occupation or use of development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority.
Reason: To help to assimilate the development into its surroundings in accordance with Policies CS1, CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies C4, D1, G2, G4, H4 and D1 of the South Oxfordshire Local Plan 2011.
Prior to the commencement of any site works (including demolition or site clearance) a protected area shall be designated for all existing trees which are shown to be retained, and the trees shall be protected in accordance with a scheme which complies with the current edition of BS 5837: "Trees in relation to design, demolition and construction" that shall first have been submitted to, and approved in writing by, the Local Planning Authority. The agreed measures shall be kept in place during the entire course of development.
Reason: To safeguard trees which are visually important in accordance with Policies CS1, CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies C4, D1, G2, G4 and H4 of the South Oxfordshire Local Plan 2011.
Prior to the first occupation of the development hereby approved, the parking and turning areas shall be provided in accordance with drawing no.16084/001C and shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles, and shall be retained unobstructed except for the parking of vehicles associated with the development at all times.
Reason: In the interests of highway safety and in accordance with Policies CS1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies D2, T1 and T2 of the South Oxfordshire Local Plan 2011.
Any gates provided shall be set back a minimum of 5.0 metres from the edge of the carriageway and shall open inwards into the site.
Reason: To ensure that vehicles may wait clear of the highway while the gates are opened or closed in the interests of highway safety in the interests of highway safety in accordance with Policies CS1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policy T1 of the South Oxfordshire Local Plan 2011.
No development including site clearance stripping or demolition shall commence until either:
a) a bat licence issued by Natural England pursuant to the Regulation 53 of The Conservation of Habitats and Species Regulations 2010 authorising the specified activity to go ahead; or
b) proof of registration of the site under a low impact class licence, has been submitted to and agreed in writing by the Local Planning Authority.
Thereafter, approved measures shall be carried out and retained in accordance with the approved details.
Reason: To protect the important species on the site, in accordance with provisions of the NPPF and policies CSB1 of the South Oxfordshire Core Strategy 2027 and C8 of the South Oxfordshire Local Plan 2011.
Notwithstanding the provisions of Classes A, B, C, D and E of Part 1 Schedule 2 of the Town and Country Planning (General Permitted Development) Order 2015 (or the equivalent provisions of any order revoking and re-enacting that Order), there shall be no extension to the dwelling hereby permitted and no ancillary buildings or structures shall be erected within the curtilage of the dwelling without the prior grant of planning permission.
Reason: In the interest of visual amenity and to ensure the development avoids an overdeveloped or cluttered appearance in accordance with Policies CS1, CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies C4, D1, G2, G4 and H4 of the South Oxfordshire Local Plan 2011.
