Conditions / Refusal Reasons
The application site lies outside of the built up limits of Peppard Common and is not a site allocated for housing in the Development Plan. The proposed development would not represent infill development as defined by the Core Strategy. The principle of the development is therefore unacceptable. Furthermore, the proposal would cause material harm to the character and intrinsic quality of this part of the Chilterns AONB and the harm would outweigh the benefits of the development. As such, the development would be contrary to Paragraph 115 of the NPPF, the NPPG and Policies CS1, CSS1, CSR1 and CSEN1 of the South Oxfordshire Core Strategy, and Policies G2, G4 and C4 of the South Oxfordshire Local Plan 2011.
In the absence of a completed S106 legal agreement, the proposal fails to secure a commuted sum towards affordable housing to meet the needs of the District. As such, the development would be contrary to guidance contained within the NPPF and NPPG and Policy CSH3 of the South Oxfordshire Core Strategy.
