Based on the information provided in the signed statutory declaration, planning statement and two accompanying letters, along with the site visit carried out on 24/08/16, and on the balance of probabilities, it has been demonstrated that the block-built, lean-to building has been in use as a self-contained, residential dwelling for a period longer than four years. As such, the use of the building defined within the attached red-edged area is lawful.
There is, however, insufficient evidence to show that the portal frame barn has been solely in residential use and has therefore been excluded from the red-edged area attached to the lawful development certificate.
On the balance of probability, the residential use of the brick-built lean-to building only is lawful under Section 171B of the Town and Country Planning (General Permitted Development) Order 1990 ("the Order") and by reference to Sections 58 and 191 of the Order.
