Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004. Related application(s): P19/S0518/DIS

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 1105.PL.006d, 1105.PL.010c, 1105.PL.011d, 1105.PL.012c, 1105.PL.004d, 1105.PL.003d, 1105.PL.005c, 1105.PL.001c, HTS 04GP, HTS 01GP and 1105.PL.002d, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

Prior to the commencement of the development hereby approved, a schedule of all materials to be used for the external finishes shall be submitted to, and approved in writing by, the local planning authority. Reason: In the interests of the visual appearance of the development in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies H4, G2 and D1 of the South Oxfordshire Local Plan 2011.

All areas of hardstanding with the site shall be of permeable, SuDS (Sustainable Drainage) compliant construction. Reason: In order to reduce the risk of surface water and fluvial flooding, in accordance with advice within the National Planning Policy Framework.

Except in the case of any building work hereby permitted, no change in the levels of the land shall take place unless in accordance with a detailed scheme which shall have been submitted to and approved in writing by the Local Planning Authority before any development commences on site. The scheme shall include details of existing and proposed ground levels. Reason: To ensure a satisfactory form of development in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2 and D1 of the South Oxfordshire Local Plan 2011.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order), no extensions, roof extensions or outbuildings, as defined by Part 1, Classes A, B and E of the Order, shall be undertaken without the prior written permission of the Local Planning Authority Reason: To ensure the Local Planning Authority retains control over any future development as specified in the condition in the interests of amenity and in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2 and D1 of the South Oxfordshire Local Plan 2011.

The trees within the site shown to be retained shall be protected in accordance with the measures outlined within the submitted Tree Protection and Landscaping Plan (Dated 16 April 2016) and Arboricultural Method Statement (Dated April 2016) Reason: To safeguard trees which are visually important in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9 and D1 of the South Oxfordshire Local Plan 2011.

The submitted landscaping scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority Reason: To help to assimilate the development into its surroundings in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9 and D1 of the South Oxfordshire Local Plan 2011.

Prior to the commencement of the development hereby approved and at an appropriate time of year, a survey of bat activity including details for their protection and any necessary mitigation measures, shall be undertaken by a suitable specialist, and shall be submitted to and approved in writing by the Local Planning Authority and any subsequent mitigation shall be undertaken in accordance with the findings of the survey. Reason: To protect the habitats of bats which are a protected species under the Wildlife and Access to the Countryside Act 1981, and in accordance with Policy CSB1 of the South Oxfordshire Core Strategy 2027 and Policies C6 and C8 of the South Oxfordshire Local Plan 2011.

The development hereby permitted shall not be occupied until foul drainage works have been carried out in accordance with details that have been first submitted to and approved in writing by the Local Planning Authority. Reason: To prevent pollution in accordance with Policy EP1 of the South Oxfordshire Local Plan 2011.

The existing dwelling at Brookfield must be demolished within three months of first occupation of the dwelling hereby approved. Reason: In order to prevent an increased risk of flooding in accordance with the National Planning Policy Framework.

The development permitted by this planning permission shall only be carried out in accordance with the approved Flood Risk Assessment (FRA) in all respects. Any variation to the approved details must be approved by the local planning authority prior to the commencement of development. Reason: To prevent an increased risk of flooding in accordance with the National Planning Policy Framework.

A Construction Traffic Management Plan (CTMP) shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of development. The approved CTMP shall be implemented prior to any works being carried out on site, and shall be maintained throughout the course of the development. Reason: In the interests of highway safety and to mitigate the impact of construction vehicles on the surrounding highway network, road infrastructure and local residents, particularly at morning and afternoon peak traffic times and in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.

Any parts of the north-west facing window openings below 1.7m from floor level shall be obscure glazed prior to first occupation of the development hereby approved and retained as such thereafter. Reason: To ensure that the development is not unneighbourly in accordance with Policies D4 and H4 or H13 of the South Oxfordshire Local Plan 2011.
