Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 001, 8151170 6101, 871.23 Revision B and BLO-001, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

The exterior of the development hereby permitted shall only be constructed in the materials specified on the plans hereby approved or in materials which shall previously have been approved in writing by the Local Planning Authority. Reason: In the interests of the visual appearance of the development in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2 and D1 of the South Oxfordshire Local Plan 2011.

That the menage and stables hereby permitted shall be used only for the riding of horses for the personal enjoyment of the occupiers of Mulberry House and shall not be used in connection with any commercial activity. Reason: To meet the particular needs of the applicant and to avoid the introduction of a commercial use in this rural location which would generate additional traffic which could be detrimental to the safety and convenience of users of the public highways in the Bix area, in accordance with Policies CS1, CSS1, CSM2 and CSEN1 of the South Oxfordshire Core Strategy 2027 and Policies G2, and R10 of the South Oxfordshire Local Plan 2011.

Prior to the first occupation of the development, the existing means of access onto the A4130 shall be improved and laid out and constructed strictly in accordance with the local highway authority's specifications and all ancillary works specified shall be undertaken. Reason: In the interest of highway safety in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.

Prior to the occupation of the stables, vision splays measuring 2.4 metres by 215 metres shall be provided to the western side of the access and the vision splays shall not be obstructed by any object, structure, planting or other material. Reason: In the interest of highway safety in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.

Prior to the first occupation of the development hereby approved, a turning area and car parking spaces shall be provided within the curtilage of the site so that motor vehicles may enter, turn around and leave in a forward direction and vehicles may park of the highway. The turning area shall be constructed, laid out, surfaced, drained and completed to be compliant with sustainable drainage (SuDS) principles in strict accordance with specification details to be submitted to and approved in writing by the Local Planning Authority prior to the commencement of development and shall be retained unobstructed except for the manoeuvring of motor vehicles at all times. Reason: In the interests of highway safety and in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.

The development hereby permitted shall not be occupied until surface water drainage works have been carried out in accordance with details that have been first submitted to and approved in writing by the Local Planning Authority. The means of drainage of the manege area should be indicated on a plan. Reason: To prevent pollution and flooding in accordance with Policies EP1, EP4 and EP6 of the South Oxfordshire Local Plan 2011.

The development hereby permitted shall not be occupied until foul drainage works and the location of the existing septic tank on the site should be confirmed, have been carried out in accordance with details that have been first submitted to and approved in writing by the Local Planning Authority. Reason: To prevent pollution in accordance with Policy EP1 of the South Oxfordshire Local Plan 2011.
