Demolition of existing dwelling, and outbuildings. Construction of replacement dwelling, car port, outdoor pool and ancillary works.
Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, A-001 C, A-003 B, A-200 A, A-202 B, A-201, A-100 A, A-101 A and A-02 A, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
Prior to the commencement of the development hereby approved samples of the materials to be used for the external walls and roofs shall be submitted to and approved in writing by the Local Planning Authority.
Reason: In the interests of the visual appearance of the development in accordance with Policy CSQ3 and CSEN2 of the South Oxfordshire Core Strategy 2027 and Policy H4, G2 and GB4 of the South Oxfordshire Local Plan 2011.
Prior to the first occupation of the development hereby approved a turning area and car parking spaces shall be provided within the curtilage of the site so that motor vehicles may enter, turn round and leave in a forward direction and vehicles may park off the highway. The turning area and parking spaces shall be constructed, laid out, surfaced, drained and completed in strict accordance with specification details. The turning area and car parking spaces shall be retained unobstructed except for the parking and manoeuvring of motor vehicles at all times.
Reason: In the interests of highway safety and to ensure the provision of off-street car parking in accordance with Policies T1 and T2 of the South Oxfordshire Local Plan 2011.
The applicant, or their agents or successors in title, shall be responsible for organising and implementing an archaeological watching brief, to be maintained during the period of construction/during any ground works taking place on the site. The watching brief shall be carried out by a professional archaeological organisation in accordance with a Written Scheme of Investigation that has first been approved in writing by the Local Planning Authority.
Reason: To safeguard the recording of archaeological matters within the site in accordance with the NPPF (2012)
Following the approval of the Written Scheme of Investigation referred to in condition 5, no development shall commence on site without the appointed archaeologist being present. Once the watching brief has been completed its findings shall be reported to the Local Planning Authority, as agreed in the Written Scheme of Investigation, including all processing, research and analysis necessary to produce an accessible and useable archive and a full report for publication.
Reason: To safeguard the recording of archaeological matters within the site in accordance with the NPPF (2012)
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order), the enlargement, improvement or other alteration of any dwellinghouse as described in Schedule 2, Part 1, Class A of the Order shall not be undertaken without the prior written permission of the Local Planning Authority.
Reason: To ensure the Local Planning Authority retains control over any future development as specified in the condition in the interests of amenity and in accordance with Policy CSQ3 and CSEN2 of the South Oxfordshire Core Strategy 2027 and Policies GB4, G2, D1 and D4 of the South Oxfordshire Local Plan 2011.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order) the provision within the curtilage of the dwelling of any building, enclosure or swimming pool as described in Schedule 2, Part 1, Class E of the Order shall not be undertaken without the prior written permission of the Local Planning Authority.
Reason: To ensure the Local Planning Authority retains control over any future development as specified in the condition in the interests of amenity in accordance with Policy CSQ3 and CSEN2 of the South Oxfordshire Core Strategy 2027 and Policies GB4, G2, D1 and D4 of the South Oxfordshire Local Plan 2011.
The development hereby permitted shall not be occupied until foul drainage works have been carried out in accordance with details that have been first submitted to and approved in writing by the Local Planning Authority.
Reason: To prevent pollution in accordance with Policy EP1 of the South Oxfordshire Local Plan 2011.
The development hereby permitted shall not be occupied until details of surface water drainage from all new hardstandings, roofs and driveways have been first submitted to and approved in writing by the Local Planning Authority.
Reason: To prevent pollution and flooding in accordance with Policies EP1, EP4 and EP6 of the South Oxfordshire Local Plan 2011.
Prior to the commencement of the development hereby approved a statement regarding the construction method of the dwelling within a high water table area and the impact caused on the high water table shall be submitted to and approved in writing by the Local Planning Authority.
Reason: To prevent pollution and flooding in accordance with Policies EP4 and EP7 of the South Oxfordshire Local Plan 2011.
Prior to the commencement of the development hereby approved, bat activity surveys shall be undertaken and a survey report containing a detailed proportional mitigation and enhancement strategy shall be submitted to the Local Planning Authority for review. These surveys shall be conducted in accordance with current best practice guidance and undertaken by a suitably qualified and trained ecologist. Only once this document has been approved in writing by the Local Planning Authority may the development commence.
REASON: To protect the important species on the site, in accordance with Policy CSB1 of the Core Strategy and Policy C8 of the South Oxfordshire Local Plan 2011.
The privacy screen along the eastern boundary, serving the second floor bedroom balcony hereby permitted shall be implemented prior to the first occupation of the dwelling in accordance with the approved plans and retained as such thereafter.
Reason: To ensure that the development is not unneighbourly in accordance with Policies D4 and H4 of the South Oxfordshire Local Plan 2011.
