The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004. Related application(s): P18/S1786/DIS

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 301 Rev 11 Sheet 3, 301 Rev 11 Sheet 4, 301 Rev 11Sheet 8, 301 Rev 11 Sheet 9, 408 V02 Sheet 5, 408 V02 Sheet 4, 301 Rev 11 Sheet 14, 301 Rev 11 Sheet 5, 301 Rev 11 Sheet 7, 301 Rev 11 Sheet 6, 408 V02 Sheet 3 and 408 V02 Sheet 7, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

That the materials used in the external construction and finishes of the hydropower building hereby permitted shall be carried out in accordance with the samples and details approved under application P15/S3515/DIS. Reason: In the interests of the visual appearance of the development in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2 and D1 of the South Oxfordshire Local Plan 2011.

The Archimedes screw hydroelectric power installation shall only be implemented in accordance with the specification detailed in Landustrie Technical Data GB13/AH 5596, as approved under application P15/S3515/DIS. Reason: In the interests of the visual appearance of the development in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2 and D1 of the South Oxfordshire Local Plan 2011.

Following initial testing of the hydropower scheme, hereby approved, and prior to the first commercial use of the development, a full noise assessment shall be submitted to and approved in writing by the Local Planning Authority. Testing should be carried out once the hydropower screws and building are located in the position indicated on plan 'V11, sheet 4 - system layout' and the scheme is operational. Reason: To safeguard the landscape character and ecological merits of the immediate area in accordance with Policy EP2 of the South Oxfordshire Local Plan 2011.

The turbine channel automatic isolator sluice shall be closed once a river tail level of 49m AOD is reached. Reason: To ensure the proposed development does not increase flood risk to third parties in line with national planning policy, as supported by the National Planning Policy Framework (NPPF.

The fish pass shall only be implemented in accordance with the specification detailed in DWG FP0202/1-7 Rev A, as approved under application P15/S3515/DIS. The scheme shall be completed in full prior to the first operation of the hydro facility hereby approved. Reason: To ensure the protection of wildlife and supporting habitat and secure opportunities for the enhancement of the nature conservation value of the site in accordance with Policy C8 of the South Oxfordshire Local Plan 2011 and in line with national planning policy, as supported by the National Planning Policy Framework (NPPF), paragraphs 109 and 118.

Notwithstanding the details approved under P15/S3515/DIS, the footbridges and handrails shall only be implemented in accordance with the details indicated on DWG 408 v02 sheets 1-7. The works shall be completed in full prior to the first operation of the hydro facility hereby approved. Reason: In the interests of the visual appearance of the development in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2 and D1 of the South Oxfordshire Local Plan 2011.

All service runs to and from the screw back to the grid shall be implemented in accordance with the details indicated on DWG COT/2/384, as approved under application P15/S3515/DIS. The works shall be completed in full prior to the first operation of the hydro facility hereby approved. Reason: To safeguard trees and hedges which are visually important in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9 and D1 of the South Oxfordshire Local Plan 2011.

The detailing and materials used for the sheet piling and their cappings shall only be implemented in accordance with the details indicated on DWG 100/5, as approved under application P15/S3515/DIS. The works shall be completed in full prior to the first operation of the hydro facility hereby approved. Reason: To safeguard trees and hedges which are visually important in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9 and D1 of the South Oxfordshire Local Plan 2011.

All site works and operations relating to the development shall be carried out in accordance with the arboricultural method statement 'Arboricultural Protection Plan: Preliminary Method Statement - July 2014', as approved under application P15/S3515/DIS, to ensure the satisfactory protection of retained trees during the construction period. Written approval of any departure from the approved arboricultural method statement must be obtained from the Local Planning authority prior to commencement of any site works including demolition. For the avoidance of doubt, the matters to be adhered to within the arboricultural method statement include the following:- (i) A specification for the pruning of, or tree surgery to, trees to be retained in order to prevent accidental damage by construction activities; (ii) The specification of the location, materials and means of construction of temporary protective fencing and/or ground protection in the vicinity of trees to be retained, in accordance with the recommendations of BS 5837 'Trees in relation to design, demolition and construction' and details of the timing and duration of its erection; (iii) The definition of areas for the storage or stockpiling of materials, temporary on-site parking, site offices and huts, mixing of cement or concrete, and fuel storage; (iv) The means of demolition of any existing site structures, and of the re-instatement of the area currently occupied thereby; (v) The specification of the routing and means of installation of drainage or any underground services in the vicinity of retained trees; (vi) The details and method of construction of any other structures such as boundary walls in the vicinity of retained trees and how these relate to existing ground levels; (vii) The details of the materials and method of construction of any roadway, parking, pathway or other surfacing within the RPA, which is to be of a 'no dig' construction method in accordance with the principles of Arboricultural Practice Note 12 "Through the Trees to Development", and in accordance with current industry best practice; and as appropriate for the type of roadway required in relation to its usage. (viii) Provision for the supervision of ANY works within the root protection areas of trees to be retained, and for the monitoring of continuing compliance with the protective measures specified, by an appropriately qualified arboricultural consultant, to be appointed at the developer's expense and notified to the Local Planning Authority, prior to the commencement of development; and provision for the regular reporting of continued compliance or any departure there from to the Local Planning Authority. Thereafter the development shall be carried out in accordance with the approved details with the agreed measures being kept in place during the entire course of development. Reason: To safeguard trees which are visually important in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9 and D1 of the South Oxfordshire Local Plan 2011.

The landscaping of the site, including the planting of live trees and shrubs, shall be carried out in accordance with Planting Plan: DWG 1518.01A, as approved under P15/S3515/DIS. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority. Reason: To help to assimilate the development into its surroundings in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9 and D1 of the South Oxfordshire Local Plan 2011.

The development hereby permitted shall only be carried out in accordance with the approved Culham Weir hydropower scheme protected species surveys and mitigation (August 2015), as approved under P15/S3515/DIS, and Culham GCN Impact Avoidance report, as approved under P14/S2430/FUL, and the mitigation measures detailed within these documents. Reason: To ensure the protection of wildlife and supporting habitat and secure opportunities for the enhancement of the nature conservation value of the site in accordance with Policy C8 of the South Oxfordshire Local Plan 2011 and in line with national planning policy, as supported by the National Planning Policy Framework (NPPF), paragraphs 109 and 118.

The development hereby permitted shall be implemented in accordance with the scheme of mitigation outlined in chapter 6 of the Extended Phase 1 Habitats Survey (January 2014), chapter 5 of the Protected Species Survey and Mitigation report (July 2014), and the Non-licensed Great Crested Newt Impact Avoidance Method Statement submitted with the application in all respects. Any variation shall be agreed in writing by the Local Planning Authority before such change is made. This condition will be discharged on receipt of a letter from the project ecologist providing evidence to demonstrate that the mitigation has been completed according to the method approved reports. Reason: To ensure the protection of wildlife and supporting habitat and secure opportunities for the enhancement of the nature conservation value of the site in accordance with Policy C8 of the South Oxfordshire Local Plan 2011 and in line with national planning policy, as supported by the National Planning Policy Framework (NPPF), paragraphs 109 and 118.

In the case where the development hereby approved has not commenced within 1 year of the grant of planning permission, a revised otter and water vole survey shall be undertaken to establish changes in the presence, abundance and impact on otters and water vole. The survey results, together with any necessary changes to the mitigation plan or method statement shall be submitted to and approved in writing the Local Planning Authority. Thereafter, the development shall be carried out in accordance with the approved details. Reason: To ensure the protection of wildlife and supporting habitat and secure opportunities for the enhancement of the nature conservation value of the site in accordance with Policy C8 of the South Oxfordshire Local Plan 2011 and in line with national planning policy, as supported by the National Planning Policy Framework (NPPF), paragraphs 109 and 118.

Notwithstanding the details approved under P15/S3515/DIS, the development shall only be carried out in accordance with the Construction Traffic Management Plan (January 2016). The approved plan shall be complied with throughout the construction period. For the avoidance of doubt, the matters to be adhered to within the plan include the following:- 1. routing protocol for vehicles entering the site from the nearest adoptable road 2. vehicle parking facilities for construction workers, other site operatives and visitors; 3. loading and unloading of plant and materials; 4. vehicle wheel washing facilities; 5. repair regime for access roads leading to the site 6. photographic condition survey of routes to be used from the nearest adoptable road to the site before and after works Reason: In the interests of highway safety and to mitigate the impact of construction vehicles on the surrounding highway network, road infrastructure and local residents, particularly at morning and afternoon peak traffic times and in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.

No lighting shall be installed without the prior grant of planning permission. Reason: To minimise disturbance to the surrounding area of high ecological value in accordance with policy EP3 of the South Oxfordshire Local Plan.
