Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, MF/13/SM/06, MF/13/SM/07, SMF/15/FP/01, SMF/15/FP/18, SMF/15/FP/17, SMF/15/FP/15, SMF/15/FP/14, SMF/15/FP/16, SMF/15/FP/20, SMF/15/FP/19, SMF/15/FP/12, SMF/15/FP/11, SMF/15/FP/21, SMF/15/FP/02 and SMF/15/FP/10, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
Prior to the commencement of the development hereby approved samples of all materials to be used in the external construction and finishes of the development hereby permitted shall be submitted to and approved in writing by the Local Planning Authority.
Reason: In the interests of the visual appearance of the development in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, D1 and H12 of the South Oxfordshire Local Plan 2011.
The 'play barn' to the rear of the development hereby permitted, shall not be occupied at any time other than for purposes incidental or ancillary to the residential use of the replacement dwelling.
Reason: As the separate occupation of the accommodation would represent an undesirable sub-division of the property and result in inadequate standards of amenity and privacy in accordance with Policy H13 of the South Oxfordshire Local Plan 2011.
Prior to the commencement of the development hereby permitted, a scheme for the landscaping of the site, including the planting of live trees, shrubs and all boundary treatments, shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority.
Reason: To help to assimilate the development into its surroundings in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9, D1 and H12 of the South Oxfordshire Local Plan 2011.
The development hereby permitted shall be implemented in accordance with the scheme of mitigation as stated in section 5.3 of the supporting Bat Emergence and Re-Entry Survey (John Wenman Ecological Consultancy, 17/08/2015, Ref: R1157/b) in all respects. Any variation shall be agreed in writing by the Local Planning Authority before such change is made. This condition will be discharged on receipt of a letter from the project ecologist providing evidence to demonstrate that the mitigation has been completed according to the method statement/approved report.
Reason: To protect the important species on the site, in accordance with Policy CSB1 of the South Oxfordshire Core Strategy 2027 and Policies G2, C8 and H12 of the South Oxfordshire Local Plan 2011.
That prior to or during the development hereby permitted, a single bat box suitable for brown long-eared bats (Plecotus auritus), such as the Schwegler 1FD, will be erected on the application site. The exact location of this bat box must be informed by a suitably trained ecologist.
This condition will be discharged on receipt of a letter from the ecologist providing evidence to demonstrate that the aforementioned habitat compensation/enhancement has been undertaken in accordance with best practice guidance.
Reason: To protect the habitats of bats which are a protected species under the Wildlife and Access to the Countryside Act 1981 and in accordance with Policy CSB1 of the South Oxfordshire Core Strategy 2027 and Policies G2, C6 and C8 and H12 of the South Oxfordshire Local Plan 2011.
Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order), no extensions or outbuildings as described in Schedule 2, Part 1, Classes A, B and E of the Order shall be erected within the curtilage of the dwellinghouse without the prior written permission of the Local Planning Authority.
Reason: To ensure the Local Planning Authority retains control over any future development as specified in the condition in the interests of amenity and in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, D1 and H12 of the South Oxfordshire Local Plan 2011.
Prior to occupation of the development hereby permitted the proposed means of access onto B4009 Shirburn Road is to be formed and laid out and constructed strictly in accordance with the local highway authority's specifications and all ancillary works specified shall be undertaken.
Reason: In the interest of highway safety in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.
Prior to the commencement of the development hereby permitted, vision splays measuring 2.4 metres by 160 metres shall be provided to each side of the access and the vision splays shall not be obstructed by any object, structure, planting or other material.
Reason: In the interest of highway safety in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.
Prior to first occupation of the dwelling hereby approves, detailed elevations of the proposed access gates shall be submitted to and approved in writing by the local planning authority. Any gates provided shall be set back a minimum of 5.0 metres from the edge of the carriageway and shall open inwards into the site.
Reason: To ensure that vehicles may wait clear of the highway while the gates are opened or closed in the interests of highway safety in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.
Unless otherwise agreed in writing by the Local Planning Authority, all areas of hard surfacing within the site shall be of permeable construction or there shall be provision to direct surface water run-off to a permeable area within the curtilage of the dwelling.
Reason: In order to reduce the impact of surface water runoff and prevent discharge onto the adjacent highway, in accordance with advice within the National Planning Practice Guidance.
