When assessing section 73 applications the Council can only consider the original condition and the reasons for applying the condition; new conditions can be attached but only in so far as they apply to the original condition. If the Council decides that planning permission should be granted, subject to the same conditions as those subject to which the previous permission was granted, they should refuse the application.
The principle of residential development as an independent unit, and in terms of its location within the district, continues to be consistent with policy at the time of determination, and there have been no significant change or relaxation in policy at national or local level. As such, a similar proposal would only be acceptable as an annex; a building tantamount to a separate dwelling would be refused in being contrary to policy CSR1 of the South Oxfordshire Core Strategy. There appear to be no changes to the proposal from the details submitted in 2003, or to the way in which the building functions, or the building itself, or policy principles, to demonstrate that the reasoning behind the need for the original condition has altered.
The reasoning for condition 3 (annex used only in connection with existing property) continues to apply and the planning permission could only be granted with the same conditions as the permission previously granted. The application is refused on these grounds.
