Conditions / Refusal Reasons
The site area and building proposed to change use under the prior approval process was granted planning permission under reference P07/W1353 and is subject to a restrictive condition: condition 2 - That the building shall be used only for horticultural or other uses falling within the definition of agriculture and for no other purpose whatsoever. Article 3(4) of The Town and Country Planning (General Permitted Development) (Amendment and Consequential Provisions) (England) Order 2015 sets out that 'Nothing in this Order permits development contrary to any condition imposed by any planning permission granted or deemed to be granted under Part III of the Act otherwise than by this Order'. The proposal is contrary to Article 3(4). In light of this restriction, the change of use and external changes cannot be considered under Class Q of Part 3 of Schedule 2 to The Town and Country Planning (General Permitted Development) (Amendment and Consequential Provisions) (England) Order 2015, and prior approval cannot be issued.
