Conditions / Refusal Reasons
That the extensive excavation required to create the basement beneath the proposed replacement building would lead to damage to the adjacent protected trees. The Horse Chestnut is a clearly visible feature of the conservation area and has sufficient arboricultural qualities to be considered as a constraint to development. As such, the proposal is contrary to policies CSEN3 of the Core Strategy and C9 of the adopted South Oxfordshire Local Plan 2011, BS 5837, 2012 Trees in Relation to Design, Demolition and Construction and advice set out in section 3.4 of the South Oxfordshire Design Guide and the supporting Trees and Development best practice guidance.
