Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 127_32_10_02, 127_32_11_02, 127_42_01, 127_81_00, 127_81_10 , 127_81_11, 127_81_12, 127_81_20, 127_81_30, 127_81_32, 127_42_12_A and 127_42_30_A, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
The exterior of the development hereby permitted shall only be constructed in the materials specified within the application form hereby approved or in materials which shall previously have been approved in writing by the Local Planning Authority.
Reason: In the interests of the visual appearance of the development in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2 and D1 of the South Oxfordshire Local Plan 2011.
Prior to the commencement of any site works (including demolition or site clearance) the trees on site shall be protected in accordance with the details specified within the Arboricultural and Planning Integration Report (GHATrees, November 2014). These measures shall be kept in place during the entire course of development.
Reason: To safeguard trees which are visually important in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9 and D1 of the South Oxfordshire Local Plan 2011.
That a landscaping scheme for trees and shrubs to replace those trees lost during development shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority.
Reason: To help to assimilate the development into its surroundings in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9 and D1 of the South Oxfordshire Local Plan 2011.
Details of the proposed 'no dig' construction of the new access driveway, as suggested within the Design and Access Statement, shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the relevant part of the development hereby permitted.
Reason: To safeguard trees which are visually important in accordance with Policies CSEN1 and CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9 and D1 of the South Oxfordshire Local Plan 2011.
Within one month of the new extensions being brought into use all other existing access points not incorporated in the development hereby permitted shall be stopped up by raising the existing dropped kerb or removing the existing bellmouth and reinstating the footway and highway boundary to the same line, level and detail as the adjoining footway and highway boundary. For the avoidance of doubt the applicants will be required to enter into a S184 Agreement with the Highway Authority in order to comply with the requirements of this condition.
Reason: To limit the number of access points along the site boundary for the safety and convenience of the highway user.
Prior to the occupation of the development, the parking and turning areas shall be provided in accordance with the submitted plan Drawing 127_32_10_02, and shall be constructed, laid out, surfaced, drained and completed, and shall be retained unobstructed except for the parking of vehicles at all times.
Reason: in the interest of highway safety and in accordance with Policy T1 and T2 and Appendix 5 (Car Parking Standards) of the South Oxfordshire Local Plan 2011.
Any gates provided shall be set back a minimum of 5.0 metres from the edge of the carriageway, and shall not open outwards from the site.
Reason: To ensure that vehicles may wait clear of the carriageway or footway while the gates are opened or closed in the interests of highway safety and in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.
No demolition or alterations to the main house shall under any circumstances commence unless the Local Planning Authority has been provided with either:
a) a licence issued by Natural England pursuant to the Regulation 53 of The Conservation of Habitats and Species Regulations 2010 authorising the specified activity to go ahead; or
b) a statement in writing from Natural England to the effect that it does not consider that the specified activity will require a licence.
Reason: To protect the important species on the site, in accordance with the requirements of the NPPF
Prior to occupation, a lighting strategy for bats shall be submitted to and approved in writing by the Local Planning Authority. The strategy shall:
a) identify those areas/features on site that are particularly sensitive for bats and that are likely to cause disturbance in or around their breeding sites or resting places or along important routes used to access key areas of their territory, for example for foraging; and
b) show how and where external lighting will be installed (through provision of appropriate lighting contour plans and technical specifications) so that it can be clearly demonstrated that areas to be lit will not disturb or prevent bats using their territory or having access to their breeding sites or resting places.
All external lighting shall be installed in accordance with the specifications and locations set out in the strategy. Under no circumstances should any other external lighting be installed without the prior consent from the local planning authority.
Reason: To protect the important species on the site, in accordance with the requirements of the NPPF.
