Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, GRA-03-401, GRA-03-131, GRA-03-301, GRA-03-305, GRA-03-601, GRA-03-121, GRA-03-501, NJJ-01, NJJ-02, NJJ-03 Tree Crown Spread, NJJ-04 Tree Retention and Protection, GRA-03-231, GRA-03-251, GRA-03-255, GRA-03-101, GRA-03-201 and 1566_200_T, except as controlled or modified by conditions of this permission. Reason: To secure the proper planning of the area in accordance with Development Plan policies.

Prior to the commencement of the development hereby approved samples of the materials to be used for the external walls and roofs shall be submitted to and approved in writing by the Local Planning Authority. Reason: In the interests of the visual appearance of the development in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies H4 and G2 of the South Oxfordshire Local Plan 2011.

The dwellings hereby approved shall achieve Level 4 of the Code for Sustainable Homes (or any such equivalent national measure of sustainability for house design which replaces that scheme). No dwelling shall be occupied until a final Code Certificate has been issued for it certifying that Code Level 4 (or any such equivalent national measure of sustainability for house design which replaces that scheme) has been achieved. Reason: To ensure high standards of sustainable design and construction in accordance with Policy CSQ2 of the South Oxfordshire Core Strategy 2027.

Prior to the first occupation of the development hereby approved a turning area and car parking spaces shall be provided within the curtilage of the site so that motor vehicles may enter, turn round and leave in a forward direction and vehicles may park off the highway. The turning area and parking spaces shall be constructed, laid out, surfaced, drained and completed in strict accordance with specification details to be submitted to and approved in writing by the Local Planning Authority prior to the commencement of development. The turning area and car parking spaces shall be retained unobstructed except for the parking and manoeuvring of motor vehicles at all times. Reason: In the interests of highway safety and to ensure the provision of off-street car parking in accordance with Policies T1 and T2 of the South Oxfordshire Local Plan 2011.

Prior to the commencement of development detailed plans showing the existing and proposed ground levels of the site together with the slab and ridge levels of the proposed development, relative to a fixed datum point on adjoining land outside of the application site, shall be submitted to and approved in writing by the Local Planning Authority. Thereafter the development shall be carried out in accordance with the approved details. Reason: To ensure a satisfactory form of development in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2 and D1 of the South Oxfordshire Local Plan 2011.

The first floor windows in the front (north-west) elevation of Dwelling 2 hereby permitted that serve the bathroom, landing and stairs shall be glazed in obscure glass, and shall be fixed shut below a height of 1.7 metres above the finished floor level of the rooms they serve with the exception of a top hung openable fanlight, or shall have their cill positioned at least 1.7 metres above the finished floor level of the room they serve, prior to the first occupation of the accommodation and it shall be retained as such thereafter. Reason: To ensure that the development is not unneighbourly in accordance with Policies D4 and H4 or H13 of the South Oxfordshire Local Plan 2011.

Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking or re-enacting that Order), no windows, doors or other openings other than those shown on the approved plans shall be inserted in the first floor, front (north-west) elevation of Dwelling 2 hereby permitted. Reason: To safeguard the amenities of adjoining occupiers in accordance with Policies D4 and H4 or H13 of the South Oxfordshire Local Plan 2011.

The first floor windows in the side elevations (north-east and south west) of the dwellings hereby permitted shall be glazed in obscure glass, and shall be fixed shut below a height of 1.7 metres above the finished floor level of the rooms they serve with the exception of a top hung openable fanlight, or shall have their cill positioned at least 1.7 metres above the finished floor level of the room they serve, prior to the first occupation of the accommodation and it shall be retained as such thereafter. Reason: To ensure that the development is not unneighbourly in accordance with Policies D4 and H4 or H13 of the South Oxfordshire Local Plan 2011.

Prior to the commencement of any site works (including demolition or site clearance) a protected area shall be designated for all existing trees which are shown to be retained, and the trees shall be protected in accordance with the submitted Arboricultural Report dated July 2014 and the Tree Retention and Protection Plan. The agreed measures shall be kept in place during the entire course of development. Reason: To safeguard trees which are visually important in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9 and D1 of the South Oxfordshire Local Plan 2011.

The development shall not begin until provision has been made to accommodate all site operatives', visitors' and construction vehicles loading, off-loading, parking and turning within the site during the construction period in accordance with details to be submitted and agreed in writing by the Local Planning Authority. Reason: In the interest of highway safety and in accordance with policy T1 of the South Oxfordshire Local Plan 2011.
