Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 920 PL04, 920 PL09, 920 PL03, 920 PL10, PL01, 920 PL05, 920 PL08, 920 PL06, 920 PL07 and PL02, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
The exterior of the development hereby permitted shall only be constructed in the materials specified on the plans hereby approved or in materials which shall previously have been approved in writing by the Local Planning Authority.
Reason: In the interests of the visual appearance of the development in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies H13, G2 and D1 of the South Oxfordshire Local Plan 2011.
Prior to the commencement of any site works or operations relating to the development hereby permitted, a site specific tree protection method statement, to ensure the satisfactory protection of retained trees during the construction period, shall be submitted to and approved in writing by the Local Planning Authority. Written approval must be obtained prior to commencement of any site works including demolition. The matters to be encompassed within the arboricultural method statement shall include the following:-
(i) A tree protection plan;
(ii) Confirmation of the exact intended location of the proposed foul and rain water drainage, required to facilitate the new building. (They should preferably be sited under the existing hard standing in front of the existing garage);
(iii) Details of further investigations (detailed decay detection and buttress investigations) to establish the condition of tree T196, a 30m tall Beech tree, identified in The Jenks Arboricultural Method Statement and Survey (January 2015), to inform a management strategy to retain the tree or justification for its removal.
Thereafter the development shall be carried out in accordance with the approved details with the agreed measures being kept in place during the entire course of development.
Reason: To safeguard trees which are visually important in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9 and D1 of the South Oxfordshire Local Plan 2011.
The development hereby permitted shall not be occupied at any time other than for purposes ancillary to the residential use of the dwelling known as Bolney Court.
Reason: As the separate occupation of the accommodation would represent an undesirable sub-division of the property and result in inadequate standards of amenity and privacy, and the site is located in an unsustainable location where new housing is not permitted, in accordance with Policies H13 and H4 of the South Oxfordshire Local Plan 2011 and Policy CSR1 of the South Oxfordshire Core Strategy 2027.
