Conditions / Refusal Reasons
The development to which this permission relates must be begun not later than the expiration of three years beginning with the date of this permission.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That the development hereby approved shall be carried out in accordance with the details shown on the following approved plans, 09-02, 09-03, 09-04, 09-05, LOC-001 rev A and 09-01 rev A, except as controlled or modified by conditions of this permission.
Reason: To secure the proper planning of the area in accordance with Development Plan policies.
The existing barn known as 'New Barn', within the blue-edged area on the approved location plan, shall only be used for storage or display purposes ancillary to the vehicle repair operation at Moorcourt Barn. No other use of this building, including the uses authorised under P09/E1311/RET, shall be undertaken without the grant of planning permission from the local planning authority.
Reason: The separate occupation and use of the building for industrial purposes would result in an undesirable intensification of traffic activity, noise and other impacts at odds with the rural character of the locality. The type and increase in vehicular movement would be likely to have an adverse impact upon highway safety, contrary to Policies D1 and T1 of the south Oxfordshire Local Plan 2011.
The building known as 'Moorcourt Barn', within the red-edged area on the approved location plan, shall only be used by Str8six, for the purposes set out in the application statement dated 30 September 2014. No other use of this building by the applicant, or any use by a new occupier, shall be undertaken without the grant of planning permission from the local planning authority.
Reason: To protect the appearance of the local area, which has a rural character and to protect the environment, wildlife and the locality from light pollution, and to minimise the number of vehicle movements to and from the site, and in accordance with Policies G2, C4 and T1 of the South Oxfordshire Local Plan 2011.
No surface water from the development shall be discharged onto the adjoining highway.
Reason: In the interests of highway safety in accordance with Policy T1 of the South Oxfordshire Local Plan 2011.
No work or associated activities including deliveries/loading/unloading/ servicing/ or parking or manoeuvring of vehicles by staff and/or visitors shall be carried out on the site at any time on Sundays or Bank Holidays, or before 08:00 or after 18:00 on Monday - Friday, or before 09:00 or after 13:00 on Saturdays.
Reason: To safeguard the amenities of the local area, and in accordance with Policies G2, C4 and EP2 of the South Oxfordshire Local Plan 2011.
That all vehicles associated with the business operation described within this planning application , including the vehicles of staff, visitors, customers and those used for deliveries shall be parked within the site area only.
Reason: To safeguard the amenities of the local area and to protect the appearance and rural character of the surrounding countryside, and to protect the public right of way adjacent to the site, and in accordance with Policies G2, G4, C4 and R8 of the South Oxfordshire Local Plan 2011.
That no external lighting shall be provided unless in accordance with an external lighting scheme that is first submitted to and approved in writing by the Local Planning Authority.
Reason: To protect the appearance of the local area, which has a rural character and to protect the environment, wildlife and the locality from light pollution, and in accordance with Policies G2, C4 and EP2 of the South Oxfordshire Local Plan 2011.
Prior to the commencement of the development hereby permitted, a scheme for the landscaping of the site, including suitable planting, areas of hardstanding and the provision of boundary fencing and screen walling, shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved in writing by the Local Planning Authority.
Reason: To help to assimilate the development into its surroundings in accordance with Policy CSQ3 of the South Oxfordshire Core Strategy 2027 and Policies G2, C9 and D1 of the South Oxfordshire Local Plan 2011.
Unless otherwise agreed in writing by the local planning authority, all areas of new hardstanding within the site shall be constructed to be SuDS (sustainable drainage) compliant.
Reason: In order to ensure that there is adequate provision for the mitigation of surface water run-off and to minimise any discharge onto the adjacent highway, in accordance with advice within the National Planning Policy Framework.
