Policy D4 of the adopted South Oxfordshire Local Plan sets out that development will not be permitted if it would unacceptably harm the amenities of neighbouring properties through loss of privacy, daylight or sunlight. The current scheme proposes a first-floor window on the side elevation, sited along the boundary and close to the windows of neighbouring habitable rooms. As a result of the development, the privacy of neighbouring occupants would be compromised, in terms of overlooking across private garden space and into habitable rooms at the back of the flats at 73A and 73B St Nicholas Road. The proposal conflicts with saved policy D4 of the adopted South Oxfordshire Local Plan and the level of harm to residential amenity is significant enough to warrant a refusal.
